ORDERV.V.S. Rao, J.1. All the petitioners in these writ petitions are residents of Gadwal Town. They are aggrieved by the proceedings of the first respondent dated 10.8.1999 whereby and whereunder the allotment of LIG/MIG plots made in favour of the petitioners sometime back were cancelled and a proposal to reauction the plots was mooted. As the background facts and the contentious issues are same, it is expedient to dispose of the writ petitions by this common order.2. With a view to improve infrastructure and facilities and to check migration from rural areas, small and medium towns to bigger towns, the Central Government sponsored Integrated Development of Small and Medium Towns (IDSMT) Scheme in 6th Five year plan in 1979-1980. The Scheme envisages development of land with all facilities fit for construction of houses and also payment of grant by the Central Government. Prakash Tatia, J.1. The State Government opened various routes for plying buses of Rapid Transport System vide notification dated 4.11.2006. The State Government further vide another notification dated 12.12.2006 granted approval of the State Government for implementation of Bus Rapid Transport System (for short BRTS) in the cities of Udaipur, Jodhpur and Kota in Rajasthan. By the same order dated 12.12.2006, the State further granted approval for constitution of Special Bus Vehicles (SPV) - a city level transport company for each of the above cities with the Names (1) 'Udaipur City Transport Services Limited' for the city of Udaipur, (2) 'Jodhpur City Transport Services Limited' for the city of Jodhpur and (3) 'Kota City Transport Services Limited' for the city of Kota. ORDER1. The petitioner is the Secretary of Sri Vinayaka Varapu Santha Vyaparasthula Sangam, Mandapalli. According to the petitioner, the sangham consists of 60 members who are all petty businessmen doing business by running vegetable shops, kirana shops, coconut shops etc., in the weekly santha (market) at Madanapalli, in an extent of 5-50 cents of land belonging to the Mandapalli Municipality, for the past several years. Every year, the Municipality conducts public auction of the right to conduct santha and the 2nd respondent was declared as the highest bidder for the present year. The members of the petitioner-Sangham have been paying the fees regularly to the 2nd respondent-contractor. Petitioner claims that the weekly market covers about 600 villages and roughly ten thousand people will attend the santha. This writ petition is filed by the petitioner questioning the allotment of shop No.1 of 'B' block at daily vegetable market at Kamareddy by the Municipality, in favour of the fourth respondent, by its resolution No. 1 /2, dated 31.5.1999. 2. The case of the petitioner is that he has erected a wooden bunk at the municipal vegetable market, Kamareddy, and was doing business along with 72 other persons similarly situated. It appears that all these 72 bunk owners are evicted/displaced for the purpose of constructing municipal shopping complex. The municipality passed the following resolution No. 2/74 (II) dated 28.9.1991 before shifting the 72 bunk owners: 'The 72 bunk owners in daily vegetable market should shift their bunks to weekly market temporarily on the condition that the said 72 bunk owners would be allotted shop rooms giving due importance on the rents fixed by the municipal council at 2that time.
