Rajesh Kumar, petitioner, aged 17 years, has filed this petition claiming compensation from the respondents on account of their negligence in maintaining the electricity supply line which resulted in electric shock to him.2. According to the petitioner, the respondent Board is responsible for super-intending, managing and controlling the transmission and supply of electricity in the State of Himachal Pradesh. On the date of occurrence, the petitioner, who is a young villager, was working in his fields. He used to earn his livelihood from the agriculture and rearing cattle. He has an aged and illiterate mother in the village. On 27.7.1993 at about 10 a.m. he took out his cattle for grazing to his fields. While doing so, the petitioner and one of his bullocks came in contact with the naked energized electric conductor. These are appeals under Section 110-D of the Motor Vehicles Act, 1939 (hereinafter, 'the Act') and are directed against a common Award dated December 29, 1982, of the Motor Accident Claims Tribunal, Shimla.2. Various claim petitions, resulting in theAward under challenge, arose out of the same accident. They were tried together, after consolidation, and by consent of parties evidence was recorded in the claim petition of claimant Nand Kishore (Claim Petition No. 17-8/2 of 1980). The accident took place on June 14, 1980, at about 5-00 p.m. when bus No. HPS 1667 beloging to the Himachal Road Transport Corporation (Local Unit, Shimla) went down the Circular Road just below Hotel Holiday Home. This criminal revision, at the instance of the accused Gurdas Singh, is against the judgment dated 30-7-1988 passed by the Sessions Judge, Una, whereby the judgment dated 27-10-1987 of Chief Judicial Magistrate, Una, District Una, was affirmed. The Chief Judicial Magistrate, Una, had convicted Gurdas Singh under Sections 279, 304-A, 337 and 338 of the Indian Penal Code and sentenced him to undergo rigorous imprisonment for six months for each of the offence. The sentences were ordered to run concurrently.2. The brief facts of the case are that in the year 1985 Gurdas Singh was working as Driver in Himachal Road Transport Corporation and was posted in its Depot at Una. He was deployed on bus No. HPG-701 which was handed over to him on 13-2-1985 after its defective brakes were repaired. A claim petition under Section 166 of Motor Vehicles Act was filed by Asha Rani (widow), Anjana Sharma (daughter), Rajesh Kumar and Anil Kumar (sons) of late Kamal Dev against the Managing Director and Regional Manager of H.R.T.C., Sukhdev Singh, driver of bus No. HK 2029 as also Gurdial Singh, driver of scooter No. DIG 5987. In this claim petition it was alleged that deceased Kamal Dev was sitting as a pillion rider on scooter being driven by Gurdial Singh. It was further alleged that when the scooter was over the Swan Bridge, one rehra was going towards Jhalera (Una side) and in the meantime a bus of H.R.T.C. bearing No. HIK 2029 came from the opposite side. The claimants alleged that Amar Nath Puri was coming in his own jeep No. DLI-3364 which was driven by Baldev Singh, Driver, and the jeep was going to Dhali.
