Petition is to the order dated 9th January, 2006 passed by Special Judge, SC/ST (Prevention of Atrocities) Cases, Sawai Madhopur whereby the revision petition filed by the petitioner has been dismissed and the order dated 10th November, 2005 passed by Judicial Magistrate, First Class, Sawai Madhopur, allowing the application under Section 311 of CrPC and summoning Babu Lal S/o Kajod as a witness, has been affirmed. 2. 1. Heard learned counsel for petitioner as well as learned Public Prosecutor and perused material made available to me during course of arguments. 2. Contention of learned counsel for petitioner is that this is first offence alleged against petitioner. Offence is under Section 19/54 of Rajasthan Excise Act, which is triable by a court of Magistrate and maximum sentence for which is five years imprisonment only. Petitioner is a driver and therefore according to him, in his case Section 6 would be attracted and maximum sentence for which is three months imprisonment.
