Court: Rajasthan
Decided on: Jul-04-2007
Reported in: RLW2008(1)Raj165; 2006WLC(Raj)UC94
Shiv Kumar Sharma, J.1. Kamla, the deceased in the instant case, appears to be a lady of easy virtue. Her character as projected by her own daughter Paras reminds us following lyric of a Maharashtra Prakrit Poet:The woman has so trained her dogThat he welcomes her loverBut growls at her husband, bares his teethWhen that poor man returns from the field. On the fateful night finding Kamla in her bedroom with a stranger, her husband (appellant herein), stabbed her to death. He was put to trial before the learned Additional Sessions Judge (Fast Track) No. 1, Jaipur City and was found guilty. Against the finding of conviction and sentence under Section 302 IPC to suffer imprisonment for life and fine, this appeal has been preferred by the appellant.2. Having heard the rival submissions we notice that the the prosecution case is founded on the dying declaration of Kamla (Ex.P-3) wherein she stated that the appellant around 1.30 AM on September 3, 1995 inflicted knife blows on her person. Dyin...

Gulab Ram Vs. State of Rajasthan and anr.

Govind Mathur, J.1. The petitioner, an Inspector, Land Records, was denied promotion to the post of Naib Tehsildar under the Rajasthan Tehsildars Service Rules, 1956 on the count that he suffered a minor penalty i.e. of censure.2. While giving challenge to the decision aforesaid the contention of counsel for the petitioner is that such a minor penalty cannot be a reason to deny promotion to next higher post where criteria for such promotion is seniority-cum-merit.3. Per contra, it is stated on behalf of the respondents that candidature of the petitioner was objectively considered by the Departmental Promotion Committee for the purpose of promotion as Naib Tehsildar but in view of the fact that he suffered a minor penalty of censure he was not found suitable to be promoted as Naib Tehsildar and this fact was communicated to him by the Registrar, Board of Revenue, Rajasthan, Ajmer under an order dt. 21.12.1993 (Anx.P/7).4. Prahlad Singh Vs. R.S.E.B. and ors.
Court: Rajasthan
Decided on: Jul-03-2007
Reported in: 2007(3)WLN465(1)
Govind Mathur, J.1. By this petition for writ though the petitioner has challenged validity of the Rajasthan State Electricity Board Employees (Emoluments) Regulations, 1978, however, at the time of arguments learned Counsel for the petitioner confines the relief to the extent of recovery made by the respondents from the pay of the petitioner against the amount said to be paid in excess. According to the respondents also the petitioner was entitled to be fixed at Rs. 260-464 on 08.11.1976 but because of some error fixation of his pay was made at Rs. 284 and he was allowed to draw the pay accordingly up to 13.10.1987. The respondents, therefore, made recovery of the amount said to be paid in excess from 8.11.1976.2. The contention of counsel for the petitioner is that whatever amount said to be paid in excess from 08.11.1976 to 13.10.1987 was paid by the respondents themselves at their own and no misrepresentation was made by the petitioner to get his pay fixed at Rs. 284/- instead of R...
