This application is filed by Rajasthan Network Private Limited having its registered office situated at B-44, Malviya Nagar, Jaipur, Rajasthan (hereinafter shall be referred to as 'the applicant transferee company' praying therein for an order to dispense with the calling of meetings of the shareholders in the matter of the consideration and approval of the scheme of amalgamation of the petitioner transferor company with Synergy Entrepreneur Solutions Private Limited (hereinafter shall be referred to as 'the transferee company').2. ORDERN.P. Gupta, J.1. The appeal was dismissed by virtue of the peremptory order dated 26.4.2005. The appeal was filed on 6.9.2004, against the award of Motor Accident Claims Tribunal, awarding the compensation. According to language of Section 173 of the M.V. Act, the appeal is required to be accompanied by the certificate, about deposit of the amount mentioned therein, but then the appeal was filed without such certificate.2. It is in these circumstances, that when the matter was listed in the Court, after more than seven months, on 26.4.2005, instead of dismissing the appeal straightaway on that day, bearing benevolence, six weeks further time was granted to file the certificate, and the order was made peremptory. Not with standing that the certificate had not been filed, the peremptory order came into action.3.
