Ashok Parihar, J.1. The petitioner was appointed as Assistant Cashier-cum-Godown Keeper on 15.09.1993. The petitioner stood retired from the same post w.e.f. 31st December, 1997 on reaching the age of superannuation. The petitioner is seeking additional five qualifying years for the purpose of calculation of pension and other retiral benefits as provided under Regulation 26 of the U.Co. Bank (Employees) Pension Regulations, 1995 mainly on the ground that the petitioner has additional higher qualifications required for the post as also the age relaxation had been given to the petitioner at the time of his appointment.2. Instant appeal impugns the judgment dated April 5, 2002 whereby the learned Single Judge allowed the misc. appeal preferred by respondent Insurance Company and dismissed the claim petition and the award of the Motor Accident Claims Tribunal Dausa.2. Claimant appellants, who were the legal heirs of Darshan Singh, filed the claim petition in respect of the death of Darshan Singh who died in an accident on June 10, 1990. It was stated in the claim petition that while Darshan Singh was going in truck No. RSB 6633, another truck No. RNG 1944 came from behind and overtook the truck No. RSB 6633. In the process of overtaking, the driver of the said truck without giving any signal suddenly applied breaks. The truck No RNG 1944 was loaded with iron girders, which were protruding outside the truck pierced into the chest of Darshan Singh who was sitting on Khalasi side, as a result of which Darshan Singh died. This appeal has been preferred against the order passed by the Motor Accident Claims Tribunal and ADJ No. 7, Jaipur City, Jaipur (for short 'the Tribunal') refusing to set aside the ex parte award which has been passed in favour of the claimant-respondents awarding compensation of Rs. 3,33,400/-. In fact the claim had been contested by the Insurance Company and during determination of the proceeding a finding was recorded that the Insurance Company was not liable to pay the compensation to the claimant-respondents as the liability of the labourers was not covered under the policy of insurance. Brief facts of the case are that about 125 plots were sold by dram Panchayat, Lathi by conducting auction during the period from 1.10.1983 to 8.5.1984. The Collector, Jaisalmer received certain complaints that the plots were sold by Gram Panchayat below the market rate and thereby loss has been caused to the Government. The Collector, Jaisalmer issued notice to Gram Panchayat. Lathi and examined the files of Gram Panchayat and cancelled the allotment of all 125 plots vide order dated 13.8.1984.
