Rathore, J.1. This petition is directed against the order dated 11.12.2001 by which the respondent Board has awarded Retail Out Let dealership of HPCL at Jaipur in favour of the respondent No. 4 Smt. Anju Kataria W/o Shri Manoj Kataria.2. The petitioner is a member of Scheduled Caste community and has passed B.E. (Mechanical) from M.B.M. Engineering College, Jodhpur in the year 1999.3. An advertisement was issued by HPCL through its Regional Office and same was published in Dainik Bhaskar dated 25.8.2000 through which the applications were invited from Scheduled Castes candidates for Retail Out Let dealership at Jaipur.4. This petition under Section 482 Cr.P.C. is directed against the order dated 15.6.2001 of the learned Sessions Judge, Bhilwara in Criminal Revision No. 136/2000 whereby the revision has been partly allowed and the order dated 20.11.2000 passed by the learned Chief Judicial Magistrate, Bhilwara so far as it pertained to the taking of cognizance against Jamnalal Somani for the offences under Sections 452, 323, 342, 166 read with Section 120-B I.P.C. was set aside but the order as regards other accused persons was upheld.2. By way of this writ petition under Article 226 of the Constitution of India, the petitioner Mewar Chamber of Commerce and Association of Industries has challenged the validity of Nagar ParishadBhilwara (Pradushan Janya Vyavsay Kar) Nlyam 2001, hereinafter referred to as 'the Rules of 2001' whereby tax has been imposed on trades, callings engaged in inter alia activity of the textile processing or trading of the raw materials for the purpose of entry of transporter/trader within the boundaries of the Municipal Council, Bhilwara with effect from 1-1-2002. The tax has been levied at the rate of Rs. 20/- per quintal of grey cloth/fibre/yarn or half per cent of value of the chemicals.2.
