ORDERLakshmanan, CJ.1. The petitioners are the owner and Driver of the vehicle which involved in the accident. The respondents No. 1 to 8 filed claim petition u/S. 166 of the Motor Vehicles Act alongwith an application u/S. 140 of the Motor Vehicles Act alleging that on 26.7.99, the accident took place and that the deceased sustained injuries and also died due to rash and negligent driving of the driver of the vehicle. The Insurance Company appeared before the Tribunal and submitted that there is violation of the policy, as such, there is no liability of the Insurance Company and they cannot be held liable. The Tribunal vide order dated 5.1.2000 awarded Rs. 50,000/- as common fault liability recoverable from the petitioners. The said order was challenged in this writ petition.(2). ORDERBalia, J.(1). Heard learned counsel for the parties.(2). This revision is by the Assessing Authority challenging the order passed by the Rajasthan Tax Board on 12.1.99 (Annexure/4).(3). The respondenl-assessee No. 1 is engaged in the business of making Double Paper Cover Aluminum Wire (D.P.C. Wire) and Strips, and also Super Enameled Aluminum Wire (S.E.M. Wire) for sale.(4). Mohd. Yamin, J. 1. This is a petition under Section 482 Cr. P.C. by petitioner Shiv Narayan Singh who appeared as a witness in Sessions Case No. 7/2000 State v. Dayaram under Section 302 IPC but did not depose in favour of the prosecution, therefore, the learned Sessions Judge while acquitting the accused, vide order dated 16.6.2000, passed certain remarks against the witness. The petitioner wants those remarks to be expunged.2. I have heard the learned Counsel for the petitioner as well as learned Public Prosecutor for the State.3.
