ORDERM.A.A. Khan, V.J.1. Heard.2. The present petitioners want to appear at the incoming Pre-Medical Test going to be held on 27-6-1996. Condition No. 3(a) of the guidelines issued by the Examining Body prescribes the minimum age at 17 years for appearing at the said test. Petitioner Ram Lal's age falls short by 9 days, that of Miss Shanti Bishnoi by one year and that of Gyaneshwar Prasad by two months of the aforesaid minimum age of 17 years prescribed for appearing at the aforementioned test.3. The contention of the learned counsel for the petitioner is that the fixation of the minimum age of 17 years is quite arbitrary and violative of Articles 14 and 16 of the Constitution of India inasmuch as it deprives qualified persons from appearing at the preadmission test for a professional course. M.A.A. Khan, V.J.1. Heard the applicant is the mother of the ravished girl Kr. Manisha aged about 13-14 years. Kr. Manisha is alleged to have been raped by three persons namely; Sanjeeve Kishore & Vijay Pal. While Sanjeeve & Kishore were chargesheeted before: the Court of Competent Magistrate, Vijay Pal was sent to the Children Court as he was alleged to be below 16 years of age at the time of commission of the offence. The applicant appears to have contested the age of Vijay Pal and in that behalf, she appears to have requested the Children Court to summon the age certificate from the institutions where Vijay Pal was alleged to have studied and also to get him medically examined for determination of his age by a Medical Board. The Children Court, however, declined to requisition the required certificate from the institutions and also to get Vijay Pal examined by a Board of Doctors for the determining his age. By this writ petition the petitioner has prayed that respondents be directed to reimburse Rs. 1,34,400/- as this amount has been spent by the petitioner for by-pass surgery and replacement of heart valves, and the respondents be further directed to re-imburse Rs. 16,000/- against post operative periodical check up treatment at Escorts Hospital, New Delhi and travelling expenses.2.
