Rajendra Saxena, J.1. Heard. Perused the case diary.2. It appears that on receiving a credible information that petitioner Ramdeo Gujar, resident of village Math, is running a tea stall near the Bus stand, on which Gheesa Ram Gujar sits and sells contraband opium and that if a search is made of the said stall, opium can be recovered; Ghewar Chand SHO, Police Station, Sadar, Pali, alongwith Police party reached the Bus stand of village Math. Ghewar Chand also took with him 'motbirs.' When they reached near the Bus stand, they saw that petitioner Jaswant Singh hastily left the place and started going towards trucks. There upon his search was taken and, it is alleged, that 45 gms. of opium was recovered from his possession for which he did not have any licence. Jaswant Singh was arrested. ORDERP.K. Palli, J. 1. The petitioner has impugned the resolution of the Regional Authority Udaipur Region, Udaipur (for short called hereinafter as 'the R.T.A.') dated 21-12-1990 (Annex. P.4) and the order of the State Transport Appellate Tribunal Rajasthan, Jaipur dated 17-5-1991 (Annexure P.6). 2. As per the averments made in the petition, the petitioner is an exisiting operator on the route Nathdwara to Kelwara holding one non-temporary permit and this route is via Vagol, Usarwas, Chaktor and Gaonguda. Respondent (sic) was operating on the route from Nathd (sic) to Sayo Ka Kheda and this route was via Vagol, Usarwas and Dhindagarh. Respondent No. 3 applied for extension of the route from Nathdwara to Palana. The distance given was 24 kms. Public Health and Engineering Department, Bundi started raising con-struction of an over-head water tank for meeting the supply of domestic water to the residents of Bundi in view of the increased population. When the construction reached the raising the pillars upto the fourth level, the inhabitants of Bundi city, as first plaintiff and five more residents, filed a suit to restrain the raising of the over-head water tank in the public park saying that it had to remain as it is for the use of the residents of the town of Bundi and for this reliance was placed on an earlier decision of this court in Citizens of Bundi v. Minicipal Board, (1987) 2 Raj LR 179 : (AIR 1988 Raj 132).
