A.K. Mathur, J.1. All these writ petitions involve common questions of law and facts, therefore, they are disposed of by this common order.2. For the convenient disposal of these writ petitions, the facts given in the case of Vinod Kumar Bharti and another v. State of Rajasthan and Ors. (S.B. Civil Writ Petition No. 3441 of 1993, are taken into consideration.3. The petitioners by this writ petition have prayed that the respondents may be directed to provide admission to the petitioners in General Nursing and Midwifery Course (called hereinafter as 'G.N.M. Course') on and from the date the candidates with lower percentage of marks were provided admission with all consequential benefits.4. Mohini Kapur, J.1. The appellant Pala Ram has been convicted for the offence under Section 376, IPC and sentenced to seven years' rigorous imprisonment and a fine of Rs. 2000/-. In default of payment of fine he has been ordered to undergo rigorous imprisonment for two months. Against this conviction and sentence made by the Addl. Sessions Judge, Raishingnagar by his judgment dated 29th June, 1991 he has preferred this appeal.2. This revision is directed against the order and judgment of the court below dated May 18, 1990, holding that the Sales Tax Department of the State of Rajasthan had a priority for recovering the amount found due from respondents Nos. 1 to 5.2. The petitioner, which is a nationalised bank, filed a suit for recovery of money on the basis of mortgage deed and other security offered by respondents Nos. 1 to 5 at the time of taking loans from the petitioner-bank. The sum claimed by the petitioner in the suit is Rs. 3,79,672.64.3. The question which arises in this appeal is whether the deceased workman died on account of personal injury caused to him by accident arising out of and is in the course of his employment.2. The facts in brief are that the husband of the respondent Ashiya Begam namely Vazir Ahmad was employed as a Senior Cook with the appellants and was performing duty in the Running Room. He used to cook on the cooking gas. On April 19, 1984 while working in the Running Room there was an accident on account of the excessive gas inhaled by him and he was admitted to the SMS Hospital, Jaipur for treatment. However, he died on April 27, 1984. It is alleged that the deceased received personal injury by accident arising out of and in the course of his employment which resulted in his death.3.
