ORDER SECURITY FORCE HELD ON 30.5.1970.The Departmental Promotion Committee set up in the Ministry of Home Affairs for considering the cases of promotion of Assistant Commandants to the rank of Deputy Commandant in the BSF met on 30.5.1970 in the room of Joint Secretary (P), Ministry of Home Affairs.2. The Committee examined the recommendations of the Central Promotion Board and also scrutinised the Confidential Charactar Rolls of all the officers who were recommended for promotion and also those who had not been recommended.3. This is an appeal under Section 110-D of the Motor Vehicles Act, 1939 filed by the claimants, who were the father and mother respectively of the deceased Gyan Chand, who was going on 27.6.1984 from village Gurdhanpura to Pragpura with his grand-uncle by Jonga jeep, against the award dated 21.1.1987 passed in Case No. 251 of 1984 by the Motor Accidents Claims Tribunal, Jaipur.2. When the deceased Gyan Chand, along with his grand-uncle, reached Pragpura and was crossing the road then suddenly Sant Lal came from Jaipur side by driving bus No. HRU 5944 with excessive speed having no control on the vehicle. He did not blow the horn and suddenly came on the wrong side of the road and hit the bus with the deceased Gyan Chand, who died on the spot due to serious injuries.3. This appeal is directed against the judgment passed by the learned Additional Sessions Judge, Raisinghnagar dated 9.11.1987 by which the appellant Om prakash was convicted Under Section 302 I.P.C. and Section 27 of the Indian Arms Act and sentenced to imprisonment for life on the first count and one year's rigorous imprisonment and fine of Rs. 200/- in default to undergo one month's imprisonment on the second count with an order that the substantial sentences shall run concurrently.2. K.C. Agrawal, C.J.1. Ramu and Goran are the parents of the deceased Sarwan, who have filed this appeal against the award dated 28.4.1986 passed by the Motor Accidents Claims Tribunal, Jaipur.2. The case of the appellants is that the deceased Sarwan was killed in an accident with bus No. RRG 7604 of the Rajasthan State Road Transport Corporation (for short 'Corporation') on 17.8.1981. The accident was due to rash and negligent driving by Mohan Lal, driver. Sarwan was only 17 years of age and was earning Rs. 25/- per day as a mason. Compensation in the sum of Rs. 4,95,250/-was claimed.3. The Corporation and Mohan Lal, driver, contested the claim petition.
