Narendra Mohan Kansliwal, J.1. This special appeal is directed against the judgment of learned Single Judge dated April 11, 1978, dismissing the writ petition filed by the appellants.2. Brief facts of the case are that the Collector, Jaipur, issued a notice to Rao Dhir Singh an ex-Jagirdar of Shahpura that an amount of Rs. 1,43,307.60 p. was due against him on account of tribute, Lagan Khalsa, District Board case and Matmi charges. By this notice dated July 6, 1970, Rao Dhir Singh was asked to deposit the afore-mentioned amount in the treasury and in case he had any objection then he could file the same with documents within 15 days. This notice was followed by reminders dated November 13, 1970, and April 2, 1971. This revision petition has raised new dimension and controversy about the constitutional validity of Section 213 Sub-clause (2) and Section 57(a) and (b) of the Hindu Succession Act.2. So far as the present case is concerned, this revision petition is directed against the order deciding the issue regarding requirement of obtaining of probate or a Will against the plaintiff. The lower court observed that unless a probate is obtained the suit cannot proceed on the basis of the Will.3. The petitioners counsel submits that this is directly against series of judgments of this court. The last one is Mst. Jadev v. Ram Swarup 1960 RLW 685 and the earliest being Bal Kishan v. N.M. Kasliwal, J.1. All the above appeals are directed against the same judgment of the learned Single Judge dated February 27, 1985, a such they are disposed of by one single order.2. Brief facts of the case are that a motorcycle No. DHT 2547 driven by Arvind Kumar met with an accident with Truck No. RJA 2936 driven by Ram Karan and owned by Ismail and Madan Lai on October 10, 1977 at 10 am. near Mahuwa Bus-stand. Prem Prakash, Ashok Kumar and Anand Kumar were pillion riders of the motor-cycle. In this accident Prem Prakash, Arvind Kumar and Ashok Kumar died on the spot after falling from motor-cycle. The truck was insured with M/s. United India Fire and General Insurance Company and the motor-cycle was insured with National Insurance Company.
