This appeal is directed against the judgment of the learned District Judge, Jodhpur dated 23-1-1987 whereby the learned District Judge has dissolved the marriage of the appellant and respondent under Section 13(2)(iv) of the Hindu Marriage Act, 1955 (for short 'the Act').2. The facts necessary to be noticed for disposal of the appeal briefly stated are that the wife-respondent filed an application for dissolution of her marriage with the hnsband-appelladt on July 3, 1985 pleading, inter alia that she was married with the husband-appellant Raju or Rajendra before about five years, i.e. at the time of the death of her great-grand mother that after marriage, she has never gone to her matrimonial home meaning thereby that her marriage has not been consumated, that even now, her age is 17 years and the has passed matriculation; that she is in a position to understand what is good for her and what is bad for her and that she does not like to keep her marital relations with ...

By his judgment dated February 24, 1977, the learned Judicial Magistrate (4), Jodbpur convicted the accused Sohan Giri under Sections 279 and 337, IPC and sentenced him to a fine of Rs. 50/-, in default of the payment of fine to undergo fifteen days' simple imprisonment on each count. The State has come-up in appeal for enhancement of the sentence.2. The accused-respondent, despite service of notice, did not put appearance. We have heard the learned Public Prosecutor.3. The offence was committed long back on June 17, 1975. The judgment was given by the Judicial Magistrate on February 24, 1977. Looking to the long lapse of ten years, it would not be proper to enhance the sentence. The appeal is, therefore, dismissed....

This appeal has been directed against the judgment of Sessions Judge, Ajmer, dated February 17, 1987, whereby the convicted the accused-appellant for offence under Section 8 read with Section 18 of the Narcotics Drugs and Psychotropic Substances Act, 1985 (here in after referred to as 'the Act') and sentenced him to 10 years' rigorous imprisonment and a fine of Rs. 1,00,000/- and in default of payment of fine the accused-appellant was ordered to suffer 1 year's further simple imprisonment.2.
