Guman Mal Lodha, J.1. These three appeals are related to award dated 19th April, 1984 passed by Shri V.P. Agrawal, Presiding Officer, Motor Accident Claims Tribunal, Jaipur in MACT Case No. 5 of 1978.2. On 24th June, 1974 late Rao Dheer Singh was going from Manoharpura to Shapura in his car No. RJL 8207. The fuel abruptly exhausted and the car was stopped allegedly on the left side of the road and the driver was asked to go to Shapura to bring the petrol. Rao Dheer Singh remained sitting in the car little knowing that instead of petrol the cruel fate is going to bring death to him by accident.3. At about 1.00 a.m. truck RJR 6607 driven by Tara Chand allegedly rashly & negligently dashed against the standing car resulting in instantaneous death of Rao Dheer Singh.4. Appellant Manphool Ram was since the year 1964 employed as a Driver in the Office of the Executive Engineer Rajasthan Canal Project, 9th Division, Chhatargarh (for short the Executive Engineer). On August 17, 1973 the Executive Engineer served on the appellant a charge-sheet containing 10 charges as enumerated in Ex. This accident took place on 28th January, 1979 at about 11.45 a.m. Shri Purushottam was driving a jeep recklessly, belonging to the State of Rajasthan which was in charge of the Executive Engineer, Irrigation Chambal Command, Bundi resulting in the accident whereby Hari Mohan husband of appellant No. 1 and father of appellant No. 2 in Civil Misc. Appeal No. 206 of 1984 was crushed and died on account of serious injuries. Ram Baboo received serious injuries.2. The Tribunal has awarded compensation to the widow of Hari Mohan and daughter of Hari Mohan. The question is whether LIC premium subsidee given to workmen by the management is to be included for the purpose of computation of wages in respect of the contribution to the Employees State Insurance fund.2. The Tribunal has come to the conclusion that it is not wages and therefore no contribution is required to be paid by the employer of the employee.3.
