This appeal of the tenant-defendant is directed against the judgment and decree of the learned District Judge, Udaipur dated September 27, 1983 by which the plaintiff's suit for eviction and arrears of rent was decreed with costs.2. Briefly recapitulated the relevant facts are that the plaintiff K.C. Jain instituted a suit for the recovery of arrears of rent and eviction of the defendant in the Court below on January 23, 1982. The case setup by him is that he is the owner of bungalow No. 28 situate in Polo-ground locality of the city of Udaipur. It was let out by the plaintiff to the defendant on January 1, 1978 for a period of two years on the monthly rent of Rs. 600/-. The tenancy was oral. The duration of tenancy came to an end on December 31, 1979. The tenant, however, did not vacate the suit premises and approached the plaintiff to continue the tenancy for next three years and offered a sum of Rs. 720/- per month as rent. The petitioner has challenged the order passed by Additional Sessions Judge, Deeg, dated 27-4-1985, whereby he set aside the order by Judicial Magistrate, Bayana dated 30-1-1985, directing the custody of vehicle No. RSD 3681 to Shyam Singh and now ordered by revisional court to be delivered to Prem Chand.2. The aforesaid vehicle was seized by police in relation to the investigation of criminal case No. 12/85 registered at Police Station Bayana on 16-1-1985, on a report lodged by petitioner, Shyam Singh, where in he gave details about the disputes in respect of the vehicle and also bringing out a case of cheating. An application under Section 457 Cr. PC was filed which, as mentioned above, was decided in favour of the petitioner. The revisional court reversed this order on the ground that Prem Chand is the registered owner of the vehicle and the final report has also been submitted by the police.3. Vinod Shanker Dave, J.1. These two miscellaneous applications under Section 482 Cr. PC are in the same proceedings under Section 125 Cr. PC and hence they are disposed of together by this single order. Though Application No. 152/85 is directed against the order, dated 4-1-1985 is an application under Section 125(5) Cr. PC and the other, dated 21-7-1984 disposing of an application under Section 125(4) Cr.PC. The present case has a chequered history. The petitioner was married with non-petitioner on May 22,1970 when the non-petitioner was only eight years of age. For six years she remained with her parents and thereafter she was sent to her husband's place where she is alleged to have stayed only for a period of ten days. During this period, the case of the petitioner is that there was no cohabitation and the marriage was not consummated and this fact is also admitted by the non-petitioner.
