ORDERK. Mal Lodha, J.1. This is a revision application by Indian Dairy Enterpreneure Agricultural Company Ltd. (for short, 'the Company') having registered office at Bhawanisingh Road, Jaipur and factory at Raniware, District Jalore which was non-applicant (opposite-party) before the Authority under the Payment of Wages Act, 1936 (No. IV of 1936) (which will hereinafter be referred to as 'the Act') and is directed against the order of the District Judge, Jodhpur dated April 6, 1978 by which he accepted the appeal of the respondent who was applicant before the Authority under the Act and set aside the order dated September 1, 1977 by which the claim under Section 15 of the Act was rejected.2. This appeal under Section 2(a) of the Supreme Court (Enlargement of Criminal Appellate Jurisdiction) Act, 1970 (Act 28 of 1970) raises a short question as to the nature of the offence made out against the appellant on the basis of the evidence adduced in Sessions Case No. 64 of 1966.2.
