This appeal has been preferred by Kailashraj, who was convicted for an offence under Section 326 I.P.C. by the Sessions Judge, Udaipur by his order dated August 6, 1974 and was sentenced to undergo one year's rigorous imprisonment and a fine of Rs. 25/- for the aforesaid offence & in default of payment of fine to further undergo 1 month's rigorous imprisonment.2. According to the prosecution case, on February 28, 1972, which was the 'Holi day' Kailashraj and Mahendrasingh accused and Madanlal and Mithulal and several other persons had gone to Ashoka Picture Cinema Hall at Udaypur for seing the picture 'Gopi', which was being exhibited in that Hall on the aforesaid day. A quarrel took place between them out-side the ticket window and in the scuffle Kailashraj halleged to have stabbed Madanlal with a knife, while Mahendrasingh is said to have stabbed Mithulal. The petitioners are the shareholders of M/s. Associated Stone Industries (Kotah) Ltd., Ramganjmandi (hereinafter referred to as 'the company'). The company was incorporated in the erstwhile-princely State of Kota on January 17, 1945, as a public limited company for carrying on the business of quarrying and polishing stones. The then Maharaja of Kotagranted a lease to the company on May 2, 1945, for a period of 15 years beginning from October, 1944. The company distributed dividends to its shareholders, including the petitioners, for the assessment years 1957-58 to 1960-61. This is an appeal by the Municipai Council, Sri Ganganagar, against the judgment of Magistrate, First Class, Sri Ganganagar dated 9-1 1974, whereby the respondent was acquitted of the off nee Under Section 7/16 of the Prevention of Food Adulteration Act, 1954.2. The prosecution case, in brief, is that the Food Inspector Veer Singh (P.W. 1) checked the respondent, while he was proceeding on a cycle with a drum containing about 9 kilo of milk on 5-8-1968 at about 9, am. He had a licence for vending milk. He purchased 660 ml. milk for a sum of 0.75 p. vide receipt Ex. P/1 for analysis. The milk purchased was put into three clean & dry bottles in equal quantity and 18 drops of formalin were put into each of the bottles and thereafter the bottles were duly packed and sealed. The non-applicant Rajaram was enlarged on bail by the Sessions Judge, Ganganagar, by his order dated 6th July, 1978, under Section 167(5), CrPC, as challan was not presented within sixty days from the date of his arrest. Rajaram was arrested on a charge under Section 302, IPC, on 10-4-1978. Charge-sheet was submitted on 9-6-1978.
