The petitioner was initially appointed in the Railway Service on May 2, 1951 as a semi skilled carpenter in the Carriage Building and Carriage Repair Trade (hereinafter briefly referred to as 'CB & CR Trade) in the Mechanical Department of the Northern Railway and was gradually promoted to higher posts in the aforesaid trade. He was ultimately promoted to the post of Chargeman Grade (B) in a substantive capacity. By the order dated July 4, 1966 the petitioner was given an officiating promotion on the post of Chargeman Grade (A) in the grade of Rs. 335-4-5 (AS) purely as a temporary measure, per ding selection in accordance with the relevant rules and since then he continued to hold the said post According to the petitioner, the Railway Board also signified its approval to the officiating promotion of the petitioner on the post of Chargeman Grade (A) vide its letter dated December 27, 1966. This writ petition by one Nand Lal is directed against the order of the State Transport Appellate Tribunal, Rajasthan, Jaipur, dated March 26, 1977, rejecting a preliminary objection that the revision preferred by the non-petitioner No 3, Laxman Kumar Arya under Section R4-A of the Motor Vehicles Act, 1939, was not maintainable.2. The material facts, in brief, are these. The petitioner held a stage carriage permit on route Kekri-Ghatiyali, which was to expire on Nov. 10, 1976. In due course, the petitioner applied for renewal of the permit on July 8, 1976 under Section 58 of the Motor Vehicles Act (hereinafter to be referred to as 'the Act').
