Act, 1961 (hereinafter referred to as 'the Act'), for requiring the Income-tax Appellate Tribunal, Jaipur Bench, to state a case and refer the following question of law alleged to be arising out of its order dated July 23, 1974, namely : 'Whether, on the facts and in the circumstances of the case, the Tribunal was justified in cancelling the penalty of Rs. 6,090 imposed by the ITO Under Section 271(1)(a)?'2. The respondent-assessee, M/s. Rawat Singh and Sons, Jodhpur, were required to file the return of their total income for the assessment year 1965-66, by September 30, 1965. They made an application for extension of time and were allowed to file the return by November 15, 1965. S.N. Modi, J.1. These three appeals are directed against the judgment of the Motor Accidents Claims Tribunal Jodhpur Civil Misc. cases Nos. 33A, 34A and 35A of 1970. As these three appeals arise out of a single accident, they ate being disposed of together by this judgment.2. The facts giving rise to these appeals are like this. On 8-3-1970 at about 8.30 p.m. three children Gopal, Karan Singh and Ram Deo along with others were playing far away from the road. Motor Truck No. DLK 1176 (Pick up) came from the side of the 5th Road Sardarpura, Jodhpur and when it reached the crossing of 3rd Road Sardarpura and Umaid Hospital Road, it deflected towards left where the boys were playing. S.N. Modi, J.1. This revision application is directed against an order of the Munsif Magistrate, Jaisalmer dated 11-8-1973.2. The relevant facts of the case are that the non-petitioner filed a suit for rendition of accounts against the petitioner. It was pleaded in the plaint that the matter has to be referred to arbitration in accordance with the terms of the agreement. In view of the above allegation the proceedings in the suit were stayed and the plaintiff was directed to file an application to refer the matter to arbitration. On 30-9-1972 the non-petitioner plaintiff moved an application under Section 20 of the Arbitration Act, 1940 with the prayer that the matter may be referred to arbitration as per agreement between the parties. This application being defective, certain objections were raised by the petitioner-defendant. On these objections the court ordered to remove the defects. Danaram, Ransingh and Jhandu were tried by the learned Additional Sessions Judge, Sri Ganganagar along with two other accused (since acquitted) in connection with an occurrence which took place on June 5, 1971 at 9 A.M. at village Rohi Paldi in the field of Budhram. In the course of that occurrence Hemraj, Nihala and Budhram sustained injuries at the hands of the accused persons. Hemraj met instantaneous death. The learned Additional Sessions Judge convicted the three appellants under Section 302 read with Section 34, I.P.C.. and sentenced each of them to imprisonment for life and a fine of Rs. 500/-, in default of the payment of which each of them was ordered to undergo rigorous imprisonment for a period of three months.
