Mohan Das and ors. Vs. Kamla Devi
Court: Rajasthan
Decided on: Dec-12-1977
Reported in: AIR1978Raj127; 1977()WLN684
Kudal, J. 1. This special appeal under Section 18 of the Rajasthan High CourtOrdinance, 1949, is directed against the judgment of the learned Single Judge dated May 9, 1977.2. Learned counsel for the respondent-decree-holder has raised preliminary objection that the appeal is not maintainable in view of the provisions of the Civil P. C. (Amendment) Act, 1976 (hereinafter referred to as the Amending Act), which came into force from Feb. 1, 1977. It was contended that by the Amending Act the definition of 'decree' in Section 2(2) of the Civil P. C. has been amended and the words 'Section 47 or' have been deleted as a result of which any order passed under Section 47 of the Civil P. C. is, therefore, not appealable. It was further contended that the intention of the Amending Act is to shorten the litigation and not to allow it to be prolonged unnecessarily in execution matters. It was further contended that in view of the recent amendment, order passed under Section 47, CPC now does not a...

Reported in: 1977WLN664
D.P. Gupta, J.1. It is not in dispute that the petitioner, who initially entered in Railway service on April 9, 1941 as Trade Apprentice in the former Jodhpur Railway, after gradual promotions, was holding the post of Chargeman Grade B, in the grade of Rs. 250-380, at the Northern Railway Workshop of Jodhpur at the relevant time. Reported in: 1977WLN(UC)450
R.L. Gupta, J.1. Plaintiffs-appellants filed a suit for eviction and arrears of rent against the respondent in the court of Munsif, Bikaner, inter alia on the ground of reasonable and bonafide necessity of the suit premises. The plaintiffs are said to be trustees of the suit property. The trial court dismissed the suit holding that there was no reasonable and bonafide necessity for the suit shop by the plaintiffs and also on the ground that though the property was a trust property, it were not the trustees from whom the defendant took the suit property on rent and as such, the plaintiffs were not held entitled to maintain the suit An appeal was preferred against that judgment and decree and that appeal was decided by the Senior Civil Judge, Bikaner, by the judgment dated 6-7-71.
