S.N. Modi, J.1. This civil first appeal is directed against the judgment and decree of the Additional District Judge, Ganganagar dated 19-9-1973 in a suit for specific performance of the contract.2. The relevant facts giving rise to this appeal are these.3. The defendant-appellant, was allotted agricultural lands situate in Chak I SEN and Chak 3 SEN, village Sabuana by the, Custodian Department. Particulars of the agricultural lands are fully mentioned in para No. 2 of the plaint On 29-1-1968 the defendant agreed to sell the entire agricultural lands to the plaintiff-respondent Sunder Singh for a sub or Rs. 17,000/- and executed an agreement in this respect on the earns day. The defendant also handed ever possession of the entire lands to the plaintiff in pursuance of the agreement. A sum of Rs. 8,000/- was paid by the plaintiff towards the sale price on the date of the agreement. This is an application-in-revision filed by Prithvi Singh against the judgment of the Sessions, Judge Balotra, dated 28th October, 1975, upholding the petitioner's conviction and sentence under Section 304A, IPC Section 3/112 and 22/123 of the Motor Vehicles Act and dismissing his appeal. It will not be out of place to mention that the petitioner was convicted by the Munsiff Magistrate, Barmer, for the aforesaid offences and sentenced to undergo rigorous imprisonment for two years and to pay a fine of Rs. 51/-, in default of payment of fine to further suffer rigorous imprisonment for fifteen days on the first count, on the second to pay a fine of Rs. 100/-, in default of payment of fine to undergo simple imprisonment for fifteen days and on the third count to pay a fine of Rs. 100/-, in default to suffer simple imprisonment for fifteen days.2. By this petition under Article 226 of the Constitution of India the petitioner has prayed that the Urban Improvement Trust, Udaipur be directed to restore possession of the land in question, which had been allotted to him as far back as on 13-2-1962 and illegally taken possession of by it from him on 30th December, 1975.2.
