S.N. Modi, J.1. This is a second appeal by the plaintiff in a suit for perpetual injunction.2. The relevant facts giving rise to this appeal may briefly be stated as under :The plaintiff after having given the highest bid of Rs. 11,800 on 9-1-1955 at a sale by public auction held in pursuance of the provisions of the Displaced Persons (Compensation and Rehabilitation) Act, 1954. hereinafter called as the Act, and the rules framed thereunder in respect of the property bearing Nos. 293, 293/1 situate in ward No. 8 at Alwar, obtained Certificate of Sale Ex. 1 signed by the Assistant Settlement Commissioner on 23-12-1958. Along with the certificate of sale, a plan of the property sold was also handed over to the plaintiff which is Ex. 2. The certificate of sale Ex. 1 mentions boundaries of the property sold, its total area, namely, 279 sq. yards and its plot Nos. 293 and 293/1. This second appeal arises out of the following circumstances: Appellant Mishit Lal took the suit premises from the respondent, Smt Prem Kumari on rent under the rent note Ex. 1 dated 10-8-63. This was a monthly tenancy commencing from 11-8-63 Rs. 200/- per month were payable as rent in advance in addition to the house-tax. The tenancy was for a fixed period of 11 months. It was also stipulated that one month's notice will be required for seeking eviction of the tenant. One of the terms of the tenancy was that the suit premises will be used only for dwelling purpose not for any commercial purpose. It is admitted that the rent was paid upto 10-9-64 On 5-12-64 a notice determining tenancy was served on the tenant calling upon him to surrender vacant possession of the suit permises. This is plaintiff's first appeal against the judgment and the decree passed by the Additional District Judge No. 2, Jaipur City dated 27th March, 1973 dismissing the plaintiff's suit for damages and for a declaration that the notification issued by the University withdrawing his B.A. degree be declared as null and void.2. The case of the plaintiff was that he appeared at the B.A. examination conducted by the Rajasthan University in the year 1962 and he was declared successful. In 1963 he took his M.A. (Previous) examination but he could not succeed. On 29th July. 1963 he was served with a notice by the defendant University asking him to submit the certificate of the institution where the plaintiff was working as a whole time paid teacher by 5th August, 1963.
