Jaggi alias Jagdish, Kishanlal, Harbans and Niranjan were charged and tried by the Sessions Judge, Alwar for various offences Jaggi was convicted under Section 302, Indian Penal Code for the murder of Parma and under Section 324, Indian Penal Code for voluntarily causing hurt with a knife to Mst. He has made a twofold prayer: firstly, he has prayed that the option that was taken from him by the Slate of Rajasthan for going to the service of the Rajasthan State Road Transport Corporation, hereinafter to be referred as 'the Corporation' was really no option and, therefore, the State Government be directed to take him back to its service and then be further directed to confirm him as upper division clerk from the year he was working as such and then give him all the consequential benefits. These two appeals-one represented and another from jail-field by Balbir arise out of the sane judgment of the learned Additional Boos Judge, Bharatpur, dated 21-9-1974, by which the appellant was convicted under Section 395, I.P.C. and sentenced to undergo rigorous imprisonment for four years and to a fine of Rs. 400/- in default of payment of fine to further suffer rigorous imprisonment for six months. As common questions of law and facts arise to the two appeals, they ate disposed of together by one judgment.2. Appellant Jogendrasingh was tried and convicted for an offence under Section 302 IPC for the murder of Roopram and sentenced to imprisonment for life and a fine of Rs. 600/- by the Additional Sessions Judge No. 2, Sri Ganganagar.
