Shinghal, J.1. Shanti Vardhman Pedi, respondent No. 3, filed a suit through its Sectary Panraj, on September 13, 1955, in the Court of Sub-Divisional Officer, Sojat, for ejectment of petitioner Chhaila under Section 183 of the Rajasthan Tenancy Act, 1955. hereinafter referred to as the Act, alleging that he was a trespasser. It was claimed in the suit that the land, Khasra No. 1567, Chat No. 2, Sojat, was the 'doli' land of the plaintiff and defendant Chhaila had taken possession without lawful authority in Samvat 2009. As Chhaila claimed that he had taken the possession through Suit. Saiaswati, respondent No. 4, she was also impleaded as a defendant. Smt. Saraswati pleaded that she was entitled to lease out the land to petitioner Chhaila. The trial court framed a number of issues including issue No. 2 which dealt with the question whether the suit land was the 'doli' land of the temple which could be cultivated only by the 'pujari'. S.N. Modi, J.1. This first appeal by the plaintiff Badshah Ram is directed against the judgment and decree of the Additional District Judge, Baran, dated 11-12-71 dismissing the suit for damages.2. The relevant facts of the case are as follows. Two parcels of land in village Anta, measuring 13 yds. by 6 yds. & 13 yds, by 3 yds. adjoining each other and constituting one plot measuring 13 yds. by 9 yds, were allotted to the plaintiff-appellant on 22-8-1956 and 24-5-1956 respectively by the Tehsildar, Anta, for purposes of a tea shop. The plaintiff in December 1960 constructed a shop over this plot of land by raising three walls on the sides and pillars with lintels on the front. Act, 1957 (hereinafter called 'the Act'), to state a case to this court in respect of the assessee's assessment for the years 1957-58 to 1964-65, and refer the following question of law : 'Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that all the wealth of the assessee including the compensation received by him under the Rajasthan Land Reforms and Resumption of Jagirs Act, 1952, for which the assessee was assessed foreach assessment year starting from 1957-58 to 1964-65 belonged to him in the capacity of the karta of a Hindu undivided family or it belonged to him as individual ?' 2.
