This is a defendant's appeal arising out of a suit for declaring an order for the removal of the plaintiff-respondent from service as null and void on account of the contravention of the principles of natural justice in the holding of the departmental inquiry culminating in the order of removal.2. The plaintiff-respondent was a member of the Railway Protection Force and was under the control of the Security Officer, Western Railway Ajmer. At the relevant time he was pasted at Abu Road Ha was seen carrying two kilograms of coal which was the property of the Railway. He was served with a charge sheet, departmental proceedings were initiated against him and finally he was visited with the penalty of removal from service by the Security Officer He went up in appeal, but without any success. Oriental Engineering Company, Jaipur, has made two applications, one under Article 226 of the Constitution of India and the other under Section 9(3) of the Central Sales Tax Act, 1956, read with Section 15(2) of the Rajasthan Sales Tax Act, 1954, against the order of the Board of Revenue, Rajasthan, dated 24th May, 1967, and they can be conveniently disposed of together.2. The petitioner is a registered firm under the Indian Partnership Act, 1932, and has been carrying on the business of selling diesel engines, generators, electric motors, pumps, bearings, etc., at Jaipur. Kan Singh, J.1. This is a defendant's second appeal arising out of a house site from the defendant.2. The plaintiff came forward with the case that he was the Jagirdar of village Sadas in Tehsil Gangrar, district Chhittorgarh The Jagir of Sadas was resumed on 1-7-54 The plaintiff submitted a list of his personal properties to the Jagir Commissioner and the latter declared the disputed plot along with some other items of property to be his personal property. It was alleged that the defendants had taken unlawful possession of this plot with the connivance of the Gram Panchayat of Sadaa. The plaintiff, therefore, prayed that the plot be declared to be of his ownership and its possession be restored to him. He also claimed Rs. 72/- as mesne profits at the rate of Rs. 2/- per month.3.
