This is an appeal taken by accused Bishan Singh, Kishan Singh and Pakhar Singh, residents of Kal-puria, police station Talera, District Bundi, against the judgment dated August 31, l'97O, of Mr. Bhanu Kumar Jain, Additional Sessions Judge, Bundi, convicting and sentencing the accused-appellants as under:1. Bishan Singh has been convicted under Section 304 (Part II), IPC and sentenced to seven years' rigorous imprisonment. He has also been found guilty under Section 447, I.P.C. and sentenced to two months' rigorous imprisonment.2. Kishan Singh and Pakhar Singh have been convicted under Section 324, I.P.C. and sentenced to one year's rigorous imprisonment each. This is a second appeal by the defendant, Mool Chand, against whom a decree for Rs. 1,209/- as arrears of rent and for ejectment from the suit premises was passed by the Civil Judge, Jaipur City and upheld in appeal by the District Judge, Jaipur City. 2. Mool Chand defendant is the owner of the house F-150 in residency area of the C-scheme. Jaipur. He mortgaged this house with possession by a registered mortgage deed dated 12-9-1956 with Prasad Dass Banerjee and his brother Narain Dass Banerjee for a sum of Rs. 15999/-. By a separate document of the same date Mool Chand was accepted as a tenant on a portion of the said house. The defendant thus continued to be in possession of that part of the house. A rent note (Ex. 1) was executed and the mortgagor agreed to pay Rs. 93/- p.m. as rent for the said part of the house. Mool Chand paid the rent for two months, upto 12-11-1956. In this second appeal the appellant is a tenant against whom a decree for ejectment has been passed by the Additional Munsif, Jodhpur and maintained in appeal by the Additional District Judge No. 1, Jodhpur.2. There is a building properly known as Lakhekhan building situate in Jodhpur inside Swanchi Gate Respondent Lakhekhan is the owner of this building The suit premises is a shop in this building. Appellant Mohanlal has been a tenant in the shop at the rent of Rs. 15/- per month. The respondent served a notice of eviction under Section 106 of the Transfer of Property Act terminating the tenancy of the appellant. The tenant did not vacate the suit shop. The prosecution version, in brief, is that at about 9.30 a.m., on Sept. 29, 1971, accused Manchida went to PW3 Nahar Singh's house, situate in Jodhpur City and told him that he was wanted by his friend Raj Kumar at Bajrang Hotel, near the Railway Loco Running Shed. Nahar Singh accompanied Manchida and both of them reached the vicinity of the above Hotel. To his utter surprise Nahar Singh saw accused Shankaria, Mohania, Kishnia and some 9 or 10 other persons standing nearby Accused Shankaria, had a slip in his hand, Mohania was armed with some lethal weapon and 3 or 4 other persons were equipped with 'lathis'. Some time latter Raj Kumar (P.W. 4.) also reached the spot after having visited his uncle. On seeing Raj Kumar, Manchida cried that he should be restrained from proceeding ahead and should be subjected to beating. J.P. Jain, J. 1. This second appeal is by the defendant Narain Singh and it arises out of a suit for specific performance instituted by respondent Dalip Singh.2. Briefly put the facts of the case are that Thakur Sangram Singh divided some of his land into plots for sale for making residential houses and named it as 'Sangram Colony'. The proposed scheme consisted of about 70 plots. Out of these plots, his son and general Attorney Kr. Narain Singh agreed to sell plot No. 49 measuring 581 Sq. yards at the rate of Rs. 6/-per Sq. yard to Dalip Singh and received from him a sum of Rs. 872/- as one-fourth price on 25-8-1956. It was agreed that a sale-deed would be executed within two months. As the land was agricultural land, proceedings for its conversion into Abadi were to be taken. The sale was, therefore, subject to the sanction of the State Government and Urban Improve-ment Board. Time for execution of the sale was extended from time to time.
