This is a revision application by the judgment-debtor against an order of the executing Court (Civil Judge, Dungarpur) holding that it has jurisdiction to execute the decree.2. The facts arc these. A suit was instituted for the recovery of a sum of Rs. 6200/- in the Court of Civil Judge. Khandwa, A decree for Rs. 4783.75 as principal was passed along with pendente lite and future interest and costs. The total amount of the decree for which the present execution application has been filed in the Court of Civil Judge, Khandwa is Rs. 10024.42. On the applica-tion of the decree-holder, the execution was transferred by the Civil Judge Khandwa to the Court of District Judge. Udaipur, who in turn transferred it to the Court of Civil Judge, Doongarpur. Before the executing Court (Civil Judge, poongarpur), an objection wag taken thatit was not competent to execute the decree as the amount of it exceeded its pecuniary jurisdiction which extends to Rs. 10000/- only. These are connected revision applications against the orders of the District Judge, Bikaner, passed as an appellate authority under the Payment of Wages Act dismissing 4 appeals filed by the Divisional Personnel Officer, Northern Railway, Bikaner, on the ground that the order passed by the Payment of Wages Authority in these 4 cases against which appeals were preferred was not a final direction against which an appeal lay.2. This is an application of M/s Maratha Mandir Ltd. under Section 446 of the Companies Act for leave to proceed with suit No. P.A.E. & R. 273/2271 1966 against the Golcha Properties Private Ltd. (hereinafter called 'the Company') in the court of Small Causes, Bombay. The applicant claims to be the owner of the premises described in paragraph 2 of the application, which are admittedly in the possession of the Company. This a revision application by the defendants against an appellate order of the District Judge, Kota. confirming an order of the Munsif, Kota, striking out their defence under Section 13(6) of the Rajasthan Premises (Control of Rent and Eviction) Act, 1950.2. The plaintiff filed the present suit for eviction inter alia on the ground of default on 20-3-67. On the first day of hearing the court passed an order under Section 13(4) determining the arrears of rent payable upto date together with interest and the amount was duly deposited by the defendants in court on the same day. Rule 33 of the Rajasthan Police Service Rules, 1954, (hereinafter to be referred as the Rules).
