This appeal is taken by the plaintiff Kanhailal against the judgment of learned District Judge, Jaipur District, dated August 19, 1961, dismissing the plaintiff's suit for a sum of Rs. 2644/12/6 (including Rs. 2100/- on account of good-will for 3 years at the rate of Rs. 700 per year, arrears Of rent and municipal charges amounting to Rs. 543/15/- from 1-1-51 to 1-10-32 and Re. 0-13-6 towards notice charges). 2. Plaintiff Gulab Chand, it appears, brought an action in the court of learned District Judge, Jaipur City, on May 28, 1953, against Kantilal and Kusumchand proprietors of the firm Kantilal Chaganlal, with the allegation that he had obtained rooms Nos. 26 and 28 in the second storey, building No. 18-20-26 from Amba Laxmi Narain Gundeli, on a monthly rental of Rs. 35/-, besides payment of municipal tax amounting to Rs. 6/57-per half year. I have before me a writ petition by Messrs Shanker Bus Service who are an existing operator on Kota-Bakanivia Jhalawar-Patan-Tendhoroute lying within the Kota region, The challenge is against an order of the Transport Appellate Tribunal on an' appeal filed before it by respondent No. 3 Balchand Chorasia whereby, in setting aside a resolusion of the Regional Trans-Authority, Kota refusing the application of the respondent Balchand Chorasia for a permit from Jhalawar to Machalpur via Mandawar-Teendhar and Bokohi-Barkena it ordered the issue of a permit to respondent No. 3 from Jhalawar to Barkhera.2. I have before me a revision application by the State of Rajasthan which is directed against an order of the Judicial First Class Magistrate, Abu Road, dated 5-8-65 by which in a case under Section 323/147 of the Indian Penal Code he recorded an order of acquittal for the offence under Section 323 of the I.P.C. on the basis of a compromise filed by the complainant and the accused non-petitioners and dropped the proceedings so far as the offence under Section 147 of the Indian Penal Code was concerned. The revision raises a short question of law whether in a case where the common object of the unlawful assembly is said to be commission of an offence under Section 323 of the Indian Penal Code and also members of the unlawful assembly are said to have caused hurt in pursuance of the common object of such an assembly and the parties have compromised the offence under Section 323 of the Indian Penal Code, such a compromise will ipso facto embrace the offence under Sectio...
