Jagat Narayan, J.1. This is a petition under Article 226 of the Constitution by five operators to whom permits were granted by the Regional Transport Authority for plying their buses between Sikar and Renwat via Palsana, Dukia, Govti, Khatu and Bay against the order of the Transport Appellate Tribunal directing them not to ply their buses via Bay 2. Seventeen applications were filed for grant of permits along this route. Seven of these applications were published in the Gazette dated 30-8-62 (annexure 2). Against the grant of permits to these 7 applicants Banshidhar and Naraindas filed an objection (annexure 4) on 25-9-62. Subsequently 10 more applications for the grant of permits along this route were published in the Gazette dated 15-11-62. These included the applications of the five petitioners. ORDERL.N. Chhangani, J. 1. This is an application by Partapa Gokala s/o. Rawat Baori, Shanker and Gokal s/o Bhomraj Jat under Sections 497 and 498, Criminal P. C. praying for their release on bail.2. The facts relevant and material for the disposal of this bail application may be briefly stated as follows:It is alleged that the four petitioners and one Madanlal Kalal hatched out a conspiracy and decided to cut the nose of one Sohanraj. In pursuance of this conspiracy, it is alleged, on 20-2-1965, the four petitioners assaulted Sohanraj. The three petitioners, Gokala Baori, Gokal Jat and Shanker held Sohanraj under control and Partap petitioner chopped off his nose. Madanlal Kalal who is a co-accused, it is alleged, was standing a few stops away from the site and joined the four petitioners when they were returning after cutting off the nose of Sohanraj. ORDERL.N. Chhangani, J.1. This is an application by Dr. S.N. Vyas under section 561-A Criminal P. C. praying for the expunction of certain remarks made against him by the Additional Sessions Judge, Ganganagar in his judgment dated 30th April, 1965 in Sessions Case No. 25 of 1964 in which three persons Jangsingh, Gurdevsingh and Ramsingh were tried for offences under Sections 447, 304, 304 read with section 34, 324 and 325 Indian Penal Code and were acquitted on the plea of right of private defence.2. The case relates to an incident which happened on 27th April, 3964 at about 7 A.M. in Chak No. 20 STG. There was some dispute between the accused and Premsingh and Dhirsingh over the allotment of 7 bighas of land for temporary cultivation. On the date of the incident the three accused went to the land in dispute and began to uproot the crop sown by Premsingh and Dhirsingh and also to overplough it. This is a petition under Article 220 of the Constitution by one Balaram against an order of the Transport Appellate Tribunal holding that no apeal lies against the order of the Regional Transport Authority granting permits to Lakhraj respondent No. 3 and Ram Prakash respondent No. 4 because they were dislodged operators to whom alternative permits were granted under Section 68-G(2) of the Motor Vehicles Act.2. The petitioner is an existing operator on the Jaipur-Diggi-Deoli-Kekri route.
