Jagat Narayan, J.1. This is a judgment-debtor's execution second appeal against an appellate order of the District Judge- Jhunjhunu.2. The facts which have given rise to it are these. Mahadeo Lal respondent No. 1 brought a suit for mandatory injunction against Thakur Bhim Singh respondent No. 2 and Dr. Ram Kumar appellant in respect of a piece of land 156 1/2ft. X 11ft, on which the appellant had made some constructions. The trial court passed a decree in favour of the plaintiff on 29-4-52. Under this decree Dr. Ram Kumar was directed to demolish his constructions standing on the land in dispute within one month failing which they were to be removed at his expense on the plaintiffs applying to the court for execution. In the alternative the defendants were given the option of paying Rs. 257/- by way of compensation to the plaintiff within one month failing which the decree for mandatory injunction was to become absolute.3. This is a reference by the learned Sessions Judge, Jhunjhunu, recommending that the order of commitment passed by the Sub-Divisional Magistrate, Nawalgarh for the trial of the accused under Sections 409, 468 and 477A I.P.C be quashed.2. The facts which led to the prosecution of the accused are that that he was Branch Post-Master in village Parasrampura from 3rd March, 1953 to 12th June, 1953, and during this period he received a number of money orders and insured letters to be delivered to their respective addressees, but instead he misappropriated the amounts to his own use, forged the receipts of the addressees and made false entries in the account books of the Branch Post Office. The number of items in respect of which misappropriation and falsification of accounts, is said to have been committed by him, is 19. The petitioner Gulab Rai Utu Mal is a Saraf of Jodhpur and carries on business of sale and purchase of bullion in the city. On 27th September, 1958, the police of Jodhpur, headed by the Deputy Superintendent of Police, who is a respondent to the application, raided the petitioner's shop situate in Sarafa Bazar. They seized three books of account of the petitioner being his Sahi Bahi, Kachchi Rokar and Pakki Rokar. This search and recovery appears to have been made in connection with the investigation of some complaint dated 26th September, 1958 purporting to refer to offences under various sections of the Indian Penal Code as also under Section 167(81) of the Sea Customs Act (VIII of 1878) read with Section 23 of the Foreign Exchange Regulation Act (VII of 1947). The facts giving rise to it are that on the 16th of July, 1957, the present petitioner, Jagdish, filed a complaint in the court of the Magistrate First Class, Neem-ka-Thana, against 11 accused for offences under Sections 452, 323, 504 and 147 of the Indian Penal Code. It was stated in the complaint that in village Ajitgarh where he was residing he had a house and near that house he had his Nohra in which a bath-room was constructed.
