Modi, J. 1. This is a writ application by Ramanand under Article 226 of the Constitution challenging his order of reduction in rank under circumstances presently to be mentioned. 2. The petitioner held the post of a Loco Foreman on the Northern Railway. He was posted at Delhi Serai Rohilla Railway Station on the 35th July, 1957. On the last-mentioned date, theDivisional Mechanical Engineer, Bikaner Division, Bikaner, served him with a charge-sheet in connection with certain complaints arising against him. The petitioner repudiated the charges, but his explanation was not considered satisfactory, and an enquiry was ordered against him by the said officer. Shri K.N. Mathur, an Assistant Mechanical Engineer was appointed Enquiry Officer. The enquiry was held from the 9th November, 1957, to the nth March, 1958. This is an application in revision by Prem Kumar who has been convicted under Section 26 of the Rajasthan Forest Act read with Rule 2 of the Rajasthan Forest (Produce Transit) Rules and has been sentenced to pay a fine of Rs. 100/ by the learned Sub-Divisional Magistrate, Bundi. This is an appeal by Mohindersingh from the judgment of the Additional Sessions Judge of Ganganagar, dated the 19th of June, 1961 convicting the accused appellant Mohindersingh under section 302 of the Indian Penal Code and sentencing him to imprisonment for life.2. The prosecution case was that the accused Mohindersingh and Dalbarasingh lived in village Chohilawali, police Station Hanumangarh, and that the deceased Gurbaxsingn also lived in the same village. There was dispute of one 'kiila' of and between them. On the 21st of October, 1960, Gurbaxsingh was coming to his house from his field with a bundle of green fodder on his head, and the accused Mohindersingh and Dalbarasingh had also gone to their field to cut 'gawar' and they inflicted injuries with an axe and a 'kassi' respectively on Gurbaxsingh, killing him instantaneously, on the spot, in the field of Mohindersingh. This writ application by Anandmal and another under Article 226 of the Constitution is directed against a notification No. 9/2/56-Lab. dated the 10th July, 1957, issued by the Government of Rajasthan under Section 3 read with Section 5 of the Minimum Wages Act, 1948, (Act No. XI of 1948) (hereinafter called the Act) by which certain minimum piece rates of wages with respect to employment in Gota Kinari establishment as specified in Schedules A to F appended to this notification were enforced in the Ajmer area, that is, the area which comprised the State of Ajmer immediately before the 1st November, 1956, and it is prayed that this notification be quashed as being illegal and discriminatory.2.
