ORDERL.N. Chhangani, J. 1. This is a reference by the Civil Judge, Beawar under Section 243 of the Rajasthan Tenancy Act and the only point which calls for determination in this reference is whether the expression 'a civil court of competent jurisdiction to decide the question whether any and which of the parties was in possession of the subject-matter in dispute' should be interpreted to include a revenue court also. 2. The facts which have given rise to this reference may be briefly slated as follows: In criminal proceedings under Section 145 Cr. P. C. State v. Keshav Sen and Raghunath, the S. D. This appeal is by defendants Nos. 1, 2 and 3, and arises out of a suit for recovery of rent instituted by the plaintiff respondent No. 1 in respect of a lease of a cinema house known as 'Sumer Talkies'.2. The case of the plaintiff is that on the 1st of May, 1948, the defendants 1 to 3, the appellants here, took a lease of the cinema house for a period of 5 years on a rent of Rs. 2,500/- a month. After running the cinema for some time, on 7-8-1948, these defendants handed over the premises to defendants 4 and 5 for running the cinema in question; and when in April 1949, there was a fire in the cinema, it is now admitted, the defendants abandoned the cinema house, and the plaintiff took possession of the same.It is also not disputed that a sum of Rs. 15,000/-vvas paid in advance to the plaintiff at the time of the lease by way of rent for a period of six months in respect of the use and occupation of the cinema house in question. This is an appeal under Section 30 of the Workmen's Compensation Act, 1923 (hereinafter referred to as the Act) by Madanlal, an employer, from the order of the Workmen's Compensation Commissioner, Jodhpur, dated 15th April, 1959, awarding a sum of Rs. 900/- to the respondent Mangali in respect of an accident resulting in the death of Miss Gopi, daughter of the respondent.2. The material facts may be very briefly stated as follows:-Madanlal, the employer, is a clerk in Maharaja Umed Mills Ltd., Pali. He owns two houses at Pali. One of the houses is used by him for his residence. The other house is utilised for purposes of leasing it to others, and the employer has been deriving in-come therefrom. ORDERJagat Narayan, J. 1. This is a revision application by one Chimna alias Mohan son of Soban alias Bada, Daroga, resident of village Bawalwara, Police Station, Jawas, District Udaipur, who was convicted under Section 411 I. P. C. and sentenced to undergo rigorous imprisonment for six months and to pay a fine of Rs. 200/-, or in, default to undergo further rigorous imprisonment for one month, by the First Class Magistrate, Kherwara. The conviction and sentence were confirmed on appeal by the Sessions Judge, Udaipur. 2. The prosecution case was that a theft took place in the house of Maji Sahiba of Bawalwara, Smt. Jumna Kaur, while she was away. The theft was discovered on her return from Bawalwara. She sent a report about it to her son Rawatji of Jawas, Shri Takhatsingh, on 12-2-51. This report was sent by Shri Takhatsingh to the S. H. O., Jawas along with a list of stolen property on 15th February, 1951.
