ORDERRanawat, J.1. This is a reference by the learned Sessions Judge, Jhunjhunu. It has been recommended by him that the order of the Magistrate dated the 9th of February, 1952 should be set aside and he be directed to proceed further with the inquiry under Section 145 of the Criminal Procedure Code according to law.2. On a complaint filed by Mahalsingh son of Doolsingh a case under Section 145, Cr. P. C. was registered by the Sub Divisional Magistrate, Udaipur. During the pendency of that case the complainant also approached the Anti Ejectment Officer on the 22nd of November, 1951 and ultimately obtained an order from him for his reinstatement as regards the plot of 17 bighas out of the total plot of 40 bighas in respect of which proceedings under Section 145 were continuing. A copy of the order of the Anti Ejectment Officer was produced by the opposite side in the court of the Magistrate and the learned Magistrate on the basis of that order shelved the proceedings on the 9th February...

Bhandari, J. 1. This is a civil second appeal on behalf of Abdul Samad Chand Mohammad and Mt. Asmat Nuri in a suit for possession of a room. Abdul Karim, father of. appellants and the appellants Abdul Sarnad and Chand Mohammad filed a suit against the defendant respondents for possession ot' a room in the Court of the Munsif, Bundi, on the 6th of May 1949. The plaintiffs alleged that they were the owners of the disputed room and one Khudabux was in possession of it on their behalf and the defendants had illegally dispossessed him so'ne two months before the filing of the suit. They, therefore, claimed possession of it. During the pendency of the suit Abdul Karim died on the 1st February 1951. Bapna, J.1. These two appeals arise out of a single suit for recovery of money.2. Kishan Lal instituted the present suit on 15-5-1948, on the allegations that he had dealings with Pabu Dan and Kami Dan, defendants Nos. 1 and 2, and on 5-11-1938, the previous account was taken. Some more advance was made, and the two defendants executed a khata of Rs. 1701 and for repayment of the amount, they hypothecated their one-fourth share in the income of Dakaniyawas, and their half share in Kothi Phalsawali, situated in the same village, for 17 years from Sarnwat 1995 to Sam-wat 2012, by way of Baraskatti, and it was stipulated that if the debtors did not permit the recovery of the income of this land in any year, they would pay Rs. 200 for that particular year. Bapna, J. 1. This is a miscellaneous appeal under Section 19(2) of the Rajasthan Town Municipalities Act 1951 (Act No. 23 of 1951). 2. In connection with the election of the members of the Town Municipal Board of Doug, the appellant. Ram Swarup, filed two nomination papers one on 13-1-1954, and the other one on 16-1-1954. His nomination papers were rejected by the Returning Officer on 20-1-1954, and when the elections were held on the 31-1-1954, Kapoorchand and Devidas were returned by Ward No, 3 for which the appellant also had been a candidate.
