ORDERSharma, J.C.1. The applicants were convicted Under Section 411, IPC and sentenced to one month's R. I. each by the Sub-Divisional Magistrate, Kekri. Their conviction and sentences have been upheld toy the learned Sessions Judge in appeal.2. The legality of the conviction Is challenged in revision.3. A theft was committed at the house of Raghubir Singh constable during the night of 15th Mid 16th September 1953. On receiving information of the theft Raghubir Singh lodged the report Ex. P/I. The stolen property was recovered from Tillage Dabalana (Rajasthan) on 17-10-1953.4. The case for the prosecution in brief was that the recovery of the different articles was Made from the accused Beoparia, Sm, Naraini, Sm. Kanti and Sm. Premi, who were in possession knowing that it was stolen property. One Ahmad was also an accused but he was acquitted.5. These are two connected cases as the validity of the Marwar Patta Ordinance, 1921, which later came to be known as the Marwar Patta Act (hereinafter called the Patta Act) arises in both. We shall deal with them together as the point involved is common. 2. The second appeal is by Tarachand and briefly the facts are these - 3. Tarachand held a decree against the judgment-debtors, respondents Maghelal and Askaran. A house of Maghelal and Askaran was sold in execution of the decree, and was purchased by Ramlal who is also a respondent in the appeal. Notice under Order XXI, Rule 66 was issued to the judgment-debtors. They, however, did not appear during the course of the execution proceedings with the result that the house was sold in the manner provided in Order XXI of the Code of Civil Procedure. Vable rejecting the complainant's request for further examination of the witnesses Under Section 258, Cr.PC2. This is a revision petition by Kalya and 6 others against the judgment of the Additional Sessions Judge at Gangapur of 30-4-1952, confirming on appeal the judgment of the Sub-Divisional Magistrate, Gangapur, of 15-4-1952, by which Kalya was convicted Under Section 325, IPC and sentenced to 2 months' R. I. and the other 6 accused were convicted Under Section 147, IPC and sentenced to a fine of Rs. 75/- each or in default they were ordered to suffer 3 weeks' further simple imprisonment.2. The prosecution case was that on 13-2-1951, Arnba and Pheli threw dust at Mst. Sunder while she was going out for some 'Puja'. She complained to Mst.
