Ranawat, J. 1. This is a revision application under Section 115, Civil P. C. by Khemchand andothers against Niranjanlal and others which hasbeen directed against an order of the District Judge, Alwar, of 19-4-1949. The facts of the case are that Khemchand and others held a decree against Swami Lakshminarain and others of the date of 2-8-1928 for Rs. 17,400/- with future interest at the rate of five annas per cent, per month payable in instalments. The last execution application was filed by the decree-holders on9-1-1942 for the recovery of Rs. 2996/- and it was prayed that this amount be collected by transferof the proprietary interests of the judgment-debtors in their lands. 25-2-1948 was fixed for consideration of certain objections filed by the judgment-debtors and for receiving their evidence. Ranawat, J. 1. This case has been referred to a larger Bench by a Division Bench of this Court. A revision application was filed in the Court of the Ijlas Khas of the former Dholpur State by the plaintiffs Babulal and Fannatel against the judgment of the then Dholpur High Court dated 3-9-1940. The case remained pending until the State of Dholpur merged into the Matsya Union and then to the State of Raja-sthan. This case eventually came on the file of this Court in accordance with the provisions of the Rajasthan Appeals and Petitions (Discontinuance) Ordinance No. 40 of 1.949 as amended by Ordinance No. 12 of 1950. During the pendency of this revision application the defendant Mannilal, opposite party, died on 19-1-1951. Nigam, J.C.1. S.N. Mehra, Camp Cleric in the Office of the Divisional Engineer Telegraphs, Ajmer, was prosecuted for charging travelling allowance for three Journeys which he had, it was so alleged, performed without purchasing railway tickets. The journeys were as under.(i) On 8-9-1948 from Ajmer to Abu Road,(ii) On 15.9.1948 from Ajmer to Reengas and(iii) On 24.12.1948 from Ajmer to Loharu.A sum of Rs. 62/9/- was claimed as travelling allowance by the charged Officer. The travelling allowance bills contained the usual certificate of the charged officer stating that he travelled in the class for which travelling allowance was claimed. The Police took up the investigation on some information received by them. After the investigation it was found that a case could be proved against the accused in respect of six journeys between 7.4.1948 and 24.12.1948.
