Gupta, J.1. This second appeal arises out of a suit for pre-emption filed originally in the Court of the Munsif, Ratangarh, against the appellant by the respondents. On 15-9-1947, the appellant Rameshwar purchased for Rs. 700 the divided share of Bhurandin son of Jivanshah Kazi of Ratangarh in a house situated at Holidhora in Ratangarh under a sale deed which was registered on 16-9-1947. On 22-12-47 one Mt. Nasiban widow of Jamaldin, who held a third share in the said house, jointly with one Piria who, she alleged, was her adopted son, filed a suit against the vendee defendant 1 and the vendor defendant 2 for pre-emption of the suit property on the ground of being proprietor of a share of the whole house and on the ground of having a common door. ORDER1. This application is made by KasturChand Jain, resident of Rajnandgaon, situate in Central Provinces under Section 491, Criminal P. C., against the order of detention to the Government of United State of Rajasthan. This order was made under Section 3, Marwar Public Security Act 1947 (III [3] of 1947) and stated that whereas theGovernment of the United State of Rajasthan was satisfied that there were reasonable grounds for believing that Kastur Chand Jain had actedand was about to act in a manner prejudicial to public safety and peace, the Government of United States of Rajaathan was pleased to authorise the Inspector of Police, Jodhpur to arrest the said Kastur Chand Jain without warrant and to commit him to the custody of the Central Jail, Jodhpur to be detained therein for a period of six months from the date of his arrest.
