Rekha Kumari, J. 1. Both the appeals arise out of the same Sessions Trial No. 102 of 1982/212 of 2001 and as such they have been heard together and this judgment would dispose of both of them. There was one more appeal being Criminal Appeal No. 437 of 2002 arising out of the same Sessions Trial but the sole appellant, in that appeal, namely, Chhotan Singh died during the pendency of the appeal. Therefore, that appeal has abated. Similarly in Criminal Appeal No. 440 of 2002, one of the appellants, namely, Dwarika Singh died during the pendency of the appeal. The appeal so far that appellant also has abated.2. In the above sessions trial the learned Adhoc District & Sessions Judge-cum-Fast Track Court, Siwan has convicted the appellants named above under Section 302/34 of the Indian Penal Code for committing murder of one Mahadeo Singh and sentenced them to undergo imprisonment for life and to pay a fine of Rs. 5000/-each and in default to undergo rigorous imprisonment for two years.3. ...

This appeal has been preferred against the judgment dated 15.12.1987 passed in Sessions Trial No. 140 of 1983 / 53 of 1985 by third Additional Sessions Judge, Madhubani whereby he has been pleased to convict both the appellants, namely, Chandeshwar Mandal alias Channa Mandal and Khirkhar Mandal under Sections 376 and 302/34 of the Indian Penal Code (hereinafter referred to as 'I.P.C.') for the offence of committing rape and murder of the informant's daughter-in-law 'Khatoon' in prosecution of their common intention. Having been convicted, the appellants were sentenced to undergo imprisonment for life under Section 302/34 of the I.P.C. and rigorous imprisonment for ten years under Section 376 of the I.P.C. Barin Ghosh, J.1. After having had worked for nine years with the Union of India the petitioner became an employee of the State of Bihar. Inasmuch as the petitioner had worked for nine years with the Union of India and inasmuch as the appointment by the State Government was not a new appointment but a continuation of the appointment as was given by the Union of India. the petitioner, in law, became entitled to increments that he had already earned while working with the Union of India Prior to the date he became an employee of the State of Bihar the having had already earned nine increments, his salary payable by the State of Bihar in the scale agreed to was fixed by adding nine increments. This was done in terms of a decision taken by the State of Bihar by a resolution bearing No. 1062 dated 12th June, '976. The Department of Mines had advertised for auction, an open bid was held on 7.10.2002. Petitioner participated in this bid and declared successful bidder as such lease was awarded in his favour. Two lease deeds were executed in his favour on 24.1.2003 and other two lease deeds on 24.3.2003.
