Petitioner is aggrieved by the detention order, bearing Letter No. 17 dated 13-1-2005, Annexure-1 to this application, passed by the District Magistrate, Begusarai, whereunder resorting to the provisions contained in sub-section (2) of Section 12 of the Bihar Control of Crime Act, 1981 (hereinafter referred to as the Act), petitioner has been detained in Begusarai District Jail. He is further aggrieved by the grounds of detention as contained in order bearing No. 24 dated 15-1-2005, Annexure-2 to this application issued by the aforesaid detaining authority. This application has been filed for quashing the order as contained in memo dated 4.11.1999 (Annexure-1), whereby the punishment inflicted on the petitioner earlier by order dated 30.11.1991 has been revived.2. Short facts giving rise to the present application are that by order as contained in memo dated 30.11.1991 (Annexure-7) the petitioner was visited with the penalty of reversion from the post of Assistant in the selection grade to that of Assistant in the basic grade with effect from 1.12.1991. By the said order it was further directed that the petitioner shall not be entitled for any other allowance other than the subsistence allowance. The applicant is widow of Late Man Mohan Dey who was appointed as casual labourer in the Postal Department on 04.04.1983 and, having worked as such continuously, he was granted temporary status w.e.f.29.11.1989 but, as the ill fate would have it, he died in harness on 11.02.1999, still working under temporary status.
