The Court does not find any error in the order of the learned Judge in declining to grant relief when the petitioner was unsuited for being considered for the grant of franchise on the allotment of a petrol pump when he had government dues amounting to Rs. 6,00,550/- and the respondents declined to issue a no objection certificate. It is entirely up to the petitioner to clear the dues and then seek the allotment for running a petrol pump. 2. There is no error in the order of the learned Judge. 3. Dismissed....

Considering any question in these two Letter Patent Appeals will be academic and nothing will come out of nothing even if the Court will to make any direction or upset the judgment which has been impugned by the present Letters Patent appeal. This is accepted by all parties whether the petitioner-appellant Nawal Kishore Singh (respondent No. 6 in the writ petition) or the respondent Jayant Kumar Lahiri (writ petitioner) or the Bihar State Sugar Corporation Limited, otherwise, the respondent Corporation. 2. The issue, raised in one of the appeals by the respondent Corporation that the Company had two cadres cannot be considered. The reason is two fold. Firstly, no foundation was laid on record that there existed two cadres to separate each unit as an establishment which was running the sugar mill or the head officer as an administrative unit. S.N. Jha, J. 1. The sole appellant of Cr. Appeal No. 421/2001 Ram Prit Rai has been awarded death sentenced upon his conviction under Section 302 of the Penal Code. All the appellants including Ram Prit Rai have been convicted under Section 302/149 of the Penal Code and sentenced to rigorous imprisonment for life. They have also been convicted under Section 307/149, 380 & 148 of the Penal Code and Section 27 of the Arms Act and sentenced to rigorous imprisonment for ten years, three years, three years and three years respectively thereunder. The sentence have been ordered to run concurrently. The sentence of death awarded to Ram Prit Rai has been sent for confirmation under Section 306 Cr. P.C. and the same has been heard along with his appeal.2. The petitioner is aggrieved by his repatriation from the State Election Commission, Bihar to the Bihar State Sugar Corporation vide Memo No. 2699 dated 30-9-2002 of the Election Commission.2. The Election Commission by letter dated 24-7-2000 requested the Rural Development Department to make available officers and employees as detailed in their letter, for their posting in the Election Commission on deputation so that it could conduct the ensuing panchayat election. The appellant-O.P. has preferred the appeal against the order dated 16.1.1998 passed in Complaint Case No. 399/1996 by District Forum, Patna directing the appellant to pay a sum of Rs. 10,907/- with interest thereon @ 18%. 2. The brief fact of the case is that complainant-respondent purchased PCMX Monitor from the appellant on 23.5.1988 for a sum of Rs. 10,712/-. Subsequently some trouble developed in the monitor and it was not writing. The complainant brought this fact to the notice of the appellant at Bangalore Office vide letter dated 21.2.1989. It is alleged that inspite of several letters written to the appellant no step was taken either to remove the defect or to refund back the price of the machine.
