Case No. 23 of 2002, in the Court of Learned Civil Judge (Jr. Div.), Jajpur, on the plea that though petitioner does not belong to Scheduled Caste, yet basing on a wrong certificate granted by Tahasildar, he got his nomination paper cleared and contested the election for the seat reserved for Scheduled Caste category. This Criminal Appeal has been filed against the judgment and order dated 3.1.1989 passed by the Special Judge, Koraput, Jeypore convicting the appellant under Section 7(1) of the Essential Commodities Act, 1955 (for short 'the Act') and sentencing him to undergo rigorous imprisonment of three months and to pay fine of Rs. 1,000/- in default to suffer simple imprisonment for three months in T.R.
