Das, J. 1.This is an application under Section 438, Cr.P.C, for grant of anticipatory bail to the petitioner, but the case has assumed importance due to regular and wide publicity made in the Press and Electronic media. Considering the above, though the Court is not required to go into the details of facts while considering an application for anticipatory bail which is a discretionary power of the Court under Section 438, Cr.P.C., in my view, it would be proper to state the case of the rival parties as it stands today.2. This appeal is directed, at the instance of the above two accused persons against the order of conviction and sentence dated 29-3-1995 passed by the learned Additional Sessions Judge, Balasore in S.T. No. 11/77 of 1994 wherein he convicted them under Sections 302/201/324 read with Section 34, IPC and sentenced each of them thereunder to undergo imprisonment for life, R.I. for two years and one year respectively.2. He submitted an application on 27.6.2002 to the SDO II, CESCO, Badambadi, Cuttack Town for supply of electricity to the residential portion of the holding occupied by him and another application dated 23.7.2002 for separate connection to the commercial establishment, namely, 'Laxmi Ladies Tailors', run by the wife of the petitioner in one of the rooms of the said holding.
