The challenge in this writ petition is to the resolution of the State Government dated 1l-10-1995 (copy whereof is Annexure 3 to the writ petition) whereby while revising the rate of State Freedom Fighters Pension from Rs. 300/- to Rupees 500/-, the State token Freedom Fighter Pension payable to Freedom Fighters or their dependants who are in receipt of S.S.S. Pension from the Central Revenue has not been revised. According to the petitioner, the action in not simultaneously revising the rate of pension payable to the S.S.S. Pension holders amounts to discrimination and liable to be quashed. The further prayer is for a direction to the opposite party No. 1 to enhance the rate of pension of the S.S.S. Pension holders at the rate of Rs. 500/- per month with effect from 11-10-1995 with a direction to pay the arrears within a stipulated period. 2. The deceased was travelling in a Trekker bearing registration number OSU-8428 belonging to present respondent No. 2. While the Trekker was proceeding from Bhadrak towards Chhatia, the Bus bearing registration number OSP-1843 belonging to respondent No. 1 came from opposite direction and dashed against the Trekker, as a result of which the Trekker was dragged to a considerable distance. The deceased died on account of the impact. Application was filed claiming compensation of rupees three lakhs.2. The owner of the Trekker did not contest the proceeding. The order of detention Under Section 3 of the National Security Act, 66 of 1980 (for short, the 'Act') was passed by the District Magistrate, Cuttack, on 26.4.1999 while the detenu was already in jail custody. The said order was served on the detenu on 27.4.1999 and the grounds of detention were served on 30.4.1 999. The State Government approved of the order of detention by order dated 6.5.1999 and the same was forwarded to the Central Government by letter dated 13.5.199. Representations were made by the detenu to the State Government as well as the Central Government on 13.5.1999. Jaipatna in the district of Kalahandi exercising powers of Revenue Officer for determining ceiling area of opp. party No. 5, namely, Srimukha Behera.
