The two petitioners and one Sadhu Saha faced trial on the accusation of having committed an offence punishable under Section 429 of the Indian Penal Code, 1860 (in short, 'IPC') read with Section 34, thereof the learned SDJM, Titilagarh found all the three accused persons guilty of such offence and convicted and sentenced each one of them to pay a fine of Rs. 500/-, In default of payment of fine, rigorous imprisonment for one month was imposed. In appeal, the learned Addl. Sessions Judge. Titilagarh set aside conviction and sentence of Sadhu Saha, but maintained them so far, as the petitioners are concerned.2. Petitioner (also referred to as the 'accused') questions his conviction for an offence punishable under Section 409 of the Indian Penal Code, 1860 (in short, 'IPC') and sentence of two years rigorous imprisonment and to pay a fine of Rs. 6,500/-, in default to undergo one year rigorous imprisonment, as awarded by learned Additional Chief Judicial Magistrate, Bhubaneswar and confirmed in appeal by the learned Additional Sessions Judge, Bhubaneshwar.2. On the accusation of rash and negligent driving which resulted in the death of a school going minor girl Bhanumati Pande (hereinafter referred to as the 'deceased'), Prafulla Kumar Rout (hereinafter referred to as the 'accused') faced trial. He was found guilty, convicted and sentenced. 2. Accusations, in short, are as follows : On 7-l-1986 at about 4 p.m. while students of Khantapade Girls' High School were returning home after closer of school, a bus named 'Madhabika' bearing registration No. SRS 3821 which was being driven by the accused came at a high speed, and dashed against the deceased, ran over her and caused her instantaneous death at the spot of accident.
