This appeal has been filed by the State of Orissa represented by the Executive Engineer, Ramiala Canal Division, Kamakhyanagar, Dis-trict-Dhenkanal against the judgment dated 16-2-1982 passed by the learned Subordinate Judge. Bhubaneswar in O. S. No. 293 of 1981-1 making the award of the learned Arbitrator a rule of the Court subject to the modification that future interest is to be limited only to the principal claim of the respondent. 2. The respondent was entrusted with certain works under the Ramiala Irrigation project by the Executive Engineer. Ramiala Canal Division under agreement No. 4 F-2 of 1978-79. As disputes arose between the parties, the Additional Director of Designs, Bhubaneswar was appointed as the Arbitrator to decide the disputes. ORDERR.C. Patnaik, J.1. This revision arises from an order of temporary injunction granted by the trial court and confirmed in appeal.2. The plaintiffs-opposite parties 2 to 6 brought a representative action seeking permanent injunction against the defendants who are the State of Orissa, its Executive Engineer and the Puri Municipality, restraining them from making any construction on the area marked 'red' in the sketch map appended to the plaint.3. The plaintiffs averred that one of them was an ex-member of the Legislative Assembly and the rest were freedom-fighters. R.C. Patnaik, J. 1. This is a plaintiff's second appeal from an action for recovery of possession. The decree granted to him by the trial court has been reversed by the lower appellate court. 2. One Gobinda Panda had three sons, namely. Bhima. Madhaba alias Pada and Shyamsundar. After Gobinda's death, the three brothers separated and partitioned their property. Madhaba and Shyam sold their shares to Bhima who thus became the absolute owner of 1.80 acres. For legal necessity, Bhima sold the entire 1.80 acres to the plaintiff by registered sale deed dated 4-8-1905 and delivered possession of the property sold. The plaintiff sold 1.15 acres to Balabhadra Kar and Krupasindhu Dash and retained Ac. 0.65 with him which is the subject matter of the suit. P.K. Mohanty, J.1. This appeal has been preferred against an order of conviction under Section 302, I. P. C. and sentence of imprisonment for life.2. The charge against the appellant was that on 6-5-79 about 8 P. M. he committed the murder of Ramachandra Dhublia of village Anta under Jeypore Police Station in the district of Koraput by dealing a knife blow on his neck. It was alleged that while the deceased was talking to P. W. 3 Damaru Naik on presence of his neighbour P. W. 5, the appellant went there and addressed the deceased as 'MISA DHUBLIA' thereby meaning that the deceased was of mixed-breed. The deceased took exception to such utterance.
