This revision is directed against the order of the District Judge, Cuttack in Misc. appeal no 132 of 1978 rejecting the prayer of the plaintiff-appellant to issue an order of mandatory injunction directing defendant No. 2 (opposite party No. 3 in this revision) to deposit in Court the amount withdrawn by him in the circumstances mentioned in the succeeding paragraphs.2. Behera, J.1. By a notification under Section 4(1) of the Land Acquisition Act (for short, 'the Act') dt. January 23, 1964, 453.25 acres of land of village Kalamati in the district of Sambalpur including 26.37 acres of land belonging to the claimants were acquired for having a State Livestock Breeding Farm. The Land Acquisition Officer fixed the compensation amount for the land at Rs. 7,056.19 paise and Rs. 26.78 paise for six trees standing thereon, totalling an amount of Rs. 7,118.97(?) paise. Being dissatisfied with the quantum of compensation, the claimants made higher claims for which the Collector made a reference under Section 18 of the Act. The claimants wanted compensation to be paid at an average rate of Rs. 10.000/- per acre for 20.26 acres of land and at the rate of Rs. 12,000/- per acre for remaining 6.11 acres of land on which a pucca house had been constructed. W. 1) at village Darada Deuli in the district of Balasore during the night of the 18th/19th January 1980, during the commission of which the culprits had used knives, bombs and lathis and had looted and removed the gold and silver ornaments, cash and other articles from his house owing to paucity of evidence against the appellant that he was one of the culprits. It was alleged in paragraph 6 of the plaint that in the property in suit, the plaintiff had 1/4 interest, the defendants 1 to 3 had 1/4, defendants 4 to 8 had 1/4 and defendants 9 to 12 had 1/4 interest. The plaintiff sought for a declaration of the shares of the different branches and for allotment of specific property. The suit was filed on 20-3-1978. The suit was decreed by the learned Munsif and the two sale deed were declared as null and void.
