Das, Ag. C.J. 1. The appellant has been convicted under section 302, IPC. and sentenced to R. I. for life for having committed the murder of his niece Sulabha alias Sulochana Dei aged about six years on 9-2-1965.2. Father of the deceased Sulochana and the appellant are two brothers who were living in the same house, but in separate mess. The mother (PW. 1) of the deceased was absent from home for sometime and during her absence, it is said that the accused managed to remove some paddy PW 1 when returned home noticed that some paddy was lying scattered. To enquiry by PW. 1 the accused denied to have any knowledge about the same, but Sulochana informed PW. 1 that it was the accused who had removed the paddy. At this, the accused got annoyed and that this is said to be the motive for the murder.3. After sometime the girl went towards the village-tank for taking bath. The girl, however, did not return. ORDERS.K. Ray, J.1. These are two applications in revision by the State against the order dated 25.4.68 of Shri D. Kanungo, Magistrate II Class, Koraput, passed in G.R. Cases Nos. 72 and 73 of 1966, in which one common judgment was passed.2. In both the cases the accused person is the same. He was convicted in both the cages under Section 380/75, I.P.C. and sentenced to undergo R.I. for 3 months and 5 days. The accused was taken to jail custody on 1.2.66 and remained in the custody till the date of judgment. The Magistrate, while sentencing him to undergo R.I. for a period of 3 months and 5 days, directed that the sentence be computed from the date when he was taken to the jail custody, that is to say, the sentence was directed to run with effect from that date. According to the Magistrate's direction the sentence expired on 6.5.68.3. The learned Counsel for the State has urged that this direction of the Magistrate making his order operative retrospectively is without jurisdiction. In ...

The election to the Orissa Legislative Assembly from the Nowrangpur Constituency was held on the 21st February, 1967. 21st of January, 1967 had been fixed as the date for scrutiny of nominations. The persons filing nominations were Sarbasri Abdul Rahiman (petitioner). Sadasiva Tripathy (Respondent). Habibulla Khan and Kasi Viswanath Sahu. The nomination of the petitioner was rejected by the Returning Officer on the 22nd of January, 1987. Sri Habibulla Khan withdrew his nomination. In a contest between Sri Sadasiva Tripathy and Sri Kasi Viswanath Sahu, the former obtained the majority of votes and was declared elected on 22nd of February, 1967.
