This appeal by the State is directed against an order of the Sub-Divisional Magistrate, Karanjia, dated 26-8-1964 acquitting the respondent of an offence under Section 16 of the Prevention of Food Adulteration Act.2. The respondent Uma Charan Ram owns a grocery shop at Jashipur in the district of Mayurbhanj. On 9-2-63, the Food Inspector (P. W. 1) inspected his shop and purchased samples of some cocoanut oil for the purpose of analysis and despatched the same in the usual course for examination by the Public Analyst with a view to find out if the said oil was pure or adulterated. He received a report (Ex. 4) from the Public Analyst saying that the sample of cocoanut oil was found to be adulterated. On receipt of Ex. 4, P.W. 1 filed a complaint (Ex. 5), after obtaining necessary sanction from the District Health Officer. The appellant Dasu Paik-rani a young woman of twenty years of age has been convicted under Section 302 Indian Penal Code and sentenced to transportation for life for having committed the murder of one female child, Sukri by name, aged about ten years, by assaulting her with a stone. She has also been convicted under Section 392 Indian Penal Code, for having robbed the child of the the gold and silver ornaments which she was then wearing on her person, but no separate sentence has been awarded thereunder. 2. The family of the appellant's parents are the residents of village Sastiguda. She has been since her marriage living with her husband in village Karanjiguda which is at a distance of about six miles from the village of her parents family. R.K. Das, J.1. This is an appeal by the Stale against the order of the Magistrate 1st Class, Panposh acquitting the respondent of an offence under Section 158 and some other sections of the I. P. C.2. It is the prosecution case that on 14-3-1954, a train carrying some refugees arrived at Rourkela railway station at about 9 p.m. A passenger travelling in the said train was found vomiting. P. W. 12 the guard of the train stopped the train and went to the compartment and called for the Railway doctor. In the mean while, it is said, the accused R.C. Chowla went to the station platform holding a piece of bread and showed it to the people there saying that the bread contained poison and that the Muslims were giving such bread to the Hindus in order to kill them. MISRA, J.1. 20th October, 1964 (Tuesday) was the day of Kumar Purnima, Moti Majhiani (the deceased) wore a number of gold and silver ornaments and went to the weekly market at Katagam. Amongst others she was wearing 3 gold Dhanamalis, 1 gold Ginimali and a gold Ball (a type of ear-ring). With these ornaments on she went to bed after taking her meals. Next morning on 21-10-64 she was found dead in the room in which she was sleeping.Dalbandhu Majhi (P. W. 1), son of the deceased lodged F. I. R. Ext. 1 at 11-30 A.M. on 21-10-64 at Kodinga P. S. 12 miles away from Landuguda, the village of the deceased. In the F. I. R. it was clearly mentioned that 3 gold Dhanmalis, 1 gold Ginimali and gold Bali had been taken away from her body. P. Ws. 11 and 12 caught hold of the accused and produced him before P. W. 13, the Officer-in-charge, Nawrangpur P. S., who arrested him at 4 p.m., on 26-10-64.
