This is an appeal against an order of acquittal, passed by the learned Magistrate 1st Class Sambalpur, in Criminal Case No. C. 1.44 of 1959, whereby the learned Magistrate had acquitted the accused respondents of a charge under Section 482/483/486 Indian Penal Code for counterfeiting the trade marks used by the firm of the complainant appellant on Biris manufacured by them in the circumstances hereinafter stated.2. The appellant (hereinafter referred to as the complainant) is the manager of a firm known as Dr. S. This is plaintiff-appellant Lucky Bidi Company's application under Article 133 of the Constitution of India for leave to appeal to the Supreme Court against the decision of a Division Bench of this Court in second appeal No. III of 1957,--setting aside the reversing decision of the learned District Judge, Sambalpur and upholding the decision of the learned Subordinate Judge Sambalpur, whereby he dismissed the suit of the plaintiff Lucky Bidi Company (petitioner herein). This is an appeal by the State of Orissa against the judgment of the Subordinate Judge of [Puri refusing to set aside an awardl dated 27th April 1956 and passing a judgment and decree in terms of that award in favour of the respondent2. The respondent was a contractor who agreed to construct four bridges on the Lewis Road in Bhubaneswar for a lump sum contract of Rs. 7,58,000/-. The terms of the contract were put in writing (See Ex. A).
