This is a petition under Article 226 of the Constitution by an ex-student of the Khallikote College Berhampur, challenging the validity of an order passed by the Principal of that College, on the 25th March 1957, expelling the petitioner from that College. The order of expulsion was issued in the form of a notice which was put up on the notice-board of the College and reads as follows:'The undersigned has come to know that Sri Ramesh Chandra Sahu of the First Year Class, Arts, has been misbehaving towards lady-students in and outside the college. It is most undesirable to have him as a student in the College. So, his name is removed from the rolls of the College from 25-3-57. Students are severely warned that similar action will be taken against them if the undersigned is not satisfied with their character and conduct at any time. This is a petition under Article 226 of the Constitution against order No. 83/57- 16329 R dated 26-9-1957, of the Government of Orissa in the Revenue Department and dismissing the petitioner from Government Service. 2. The petitioner was a permanent non-gazetted Government Servant holding the post of Sub-Registrar under the Government of Orissa. On 2-8-1954 he was placed under suspension and departmental proceedings against him were enquired into by the Member, Administrative Tribunal, in accordance with the provisions of the Disciplinary Proceedings (Administrative Tribunal) Rules. 1951. After conducting the enquiry the Tribunal held him guilty of charges of corruption and reported to Government recommending his dismissal from service. ORDERR.L. Narasimham, C.J. 1. This is a revision for quashing a criminal proceeding under Section 505 I. P. C. initiated by the Sub-divisional Magistrate of Talcher against the petitioner and some other persons. 2. On 5-5-58 one Srinivas Sahu who is said to be the Sarbarakar of Talcher Town filed a complaint before the Sub-divisional Magistrate againstone Sri Dibakar Misra alleging that the latter had distributed copies of a printed pamphlet at various places in Talcher town on 13-4-1958 with the intention of inciting the general public of Talcher Town against the Government Officials stationed at that place and against some of the political parties and also some lawyers. The Sub-Divisional Magistrate, after examining the complainant on solemn affirmation, summoned the said Dibakar Misra, under Section 505 I. P. C. This is a petition under Article 226 of the Constitution against the order of the District Collector of Ganjam dated the 2nd March 1957, dismissing the petitioner from service.2. The petitioner was serving in Ganjam Collectorate for about 13 years and rose to the rank of Head-Clerk of the Civil Supplies Branch of that Coliectorate at Chatrapur. In 1951-52 the petitioner was working as the Head-clerk of the Civil Supplies Branch of the Sub-Collector's Office at Berhampur. On receipt of information about corruption while he was working in that capacity, a preliminary confidential investigation was made by some C.I.D. Rao, Additional District Judge of Puri dismissing her suit for a declaration that the adoption of defendant No. 1 was not true and valid.2. The plaintiff-appellant Netramani Debi and defendant No. 3 Suryamani Devi are the daughters of Taluchha Brundaban Mohapatro and his wife is defendant No. 2 Lakshmi Dibya. Brundaban was the sebayat of the temple of Shri Jagannath of Puri and he died on 3-9-43. Lakhmi Dibya succeeded to his properties and according to the plaintiffs case, defendant No. 1 Lakshminarayan Kar, natural son of Lokenath Kar, had been set up as the adopted son of the deceased Brundaban Mohapatra by obtaining a fraudulent deed of adoption from the widow of Brundaban on 29-9-43 and registered on 3-11-43 by Lokenath Kar.
